The case later went to trial: a jury convicted him in March 2025 of racketeering conspiracy, attempted murder and assault with a deadly weapon in aid of racketeering, and a firearm-discharge offense. On December 16, 2025, he was sentenced to 30 years in prison followed by five years of supervised release.
Why was Kay Flock indicted?
Federal prosecutors alleged that Perez was involved in Sev Side/DOA, a Bronx-based gang, and charged him with racketeering conspiracy and crimes they said were connected to gang violence. The indictment, unsealed by the U.S. Attorney’s Office for the Southern District of New York (SDNY) on February 23, 2023, included a murder charge concerning Hwascar Hernandez, who was shot in Upper Manhattan on December 16, 2021. The charging announcement described allegations, not findings of guilt; the office expressly noted that defendants were presumed innocent unless proven guilty. SDNY’s 2023 charging announcement and the indictment set out the original charges.
What charges did the indictment include?
The 2023 indictment charged Perez with racketeering conspiracy, murder in aid of racketeering, use of a firearm resulting in death, attempted murder and assault with a dangerous weapon in aid of racketeering, and related firearm offenses. These were the charges at the indictment stage; they should not be confused with the jury’s later verdict.
The same SDNY announcement covered two related but distinct groups, Sev Side/DOA and Third Side. It referred to seven shootings tied to charges against specified defendants from the two groups between June 2020 and February 2022. That figure describes the announcement’s allegations across those defendants; it does not mean prosecutors attributed all seven shootings to Perez.

What did the jury convict Kay Flock of?
On March 20, 2025, SDNY announced that a jury had convicted Perez of racketeering conspiracy, attempted murder and assault with a deadly weapon in aid of racketeering, and a firearm-discharge offense. The conviction statement is available from SDNY.
The conviction and sentencing announcements do not give the full count-by-count verdict. They do not establish whether the jury convicted Perez on the original murder charge, so it is accurate to call that a charge in the indictment, but not to state on these sources that he was convicted of murder.

What sentence did he receive?
On December 16, 2025, U.S. District Judge Lewis J. Liman sentenced Perez to 30 years in prison followed by five years of supervised release. Those are the sentence terms announced by SDNY, not a general sentencing range. The sentencing announcement lists the convictions and sentence.

SDNY’s 2023 release alleged that members of Sev Side/DOA and Third Side carried out shootings and used social media and music to promote gang activity. In its 2025 sentencing announcement, the office said that, according to the indictment, public court filings and trial evidence, the gang primarily supported itself through bank and wire fraud, which funded Perez’s music career. These are descriptions attributed to prosecutors and the government’s account of the case.

In the sentencing announcement, U.S. Attorney Jay Clayton said Perez “used violence and fame to fuel fear and intimidation across the Bronx.” Judge Liman, as quoted by the office, said Perez “taunted, celebrated, and created a culture of violence” and that the harm he caused “was immense.” These statements reflect the speakers’ views in the context of sentencing, rather than a separate description of the verdict.
