Run the fundraiser and the giveaway as two related but distinct parts of the event: make the donation route transparent, publish complete giveaway rules before entries open, and let viewers enter without donating. State the closing time and time zone, use one consistent clock, and choose the winner exactly as the rules say. The legal guidance below is US-focused; rules can vary by state and locality, and this is not legal advice.
What should you decide before announcing the giveaway?
First settle the event’s two separate questions: how donations reach the charity, and how viewers qualify for the prize. A donation is not an entry fee. For a US sweepstakes-style random drawing, do not require a purchase or donation to enter or to receive better odds. The FTC says purchase-required sweepstakes are illegal in the United States. A raffle or another chance-based format can raise separate state and local issues, so get jurisdiction-specific advice before using one.
Confirm the charity and your authority to fundraise
- Confirm the intended beneficiary and the exact organization or platform that will receive the payment first.
- If you are organizing the event on a charity’s behalf, obtain clear authorization in writing. The IRS says a qualified charity should conduct a fundraising event, or clearly authorize an outside organizer as its agent, for donors to document gifts as contributions to that qualified charity.
- Check whether charitable solicitation registration or reporting applies where you are organizing and where you solicit donations. The IRS notes that many states require registration and periodic reports, and some local governments have their own requirements.
Choose the actual giveaway format
Decide whether the winner is selected randomly, by skill, or by another method, and describe it accurately. Calling a random drawing a “contest” does not change how it works. The legal treatment can depend on the mechanics, prize, charity, organizer’s location, and entrants’ locations; the IRS notes that gaming activities including raffles and lotteries are normally regulated by state and local law.
What rules do you need before you go live?
Publish the complete official rules before accepting entries, then administer the giveaway by those rules. For a YouTube contest, YouTube requires free entry, official rules and required disclosures, a privacy notice, and a statement that YouTube is not a sponsor. The rules must link to YouTube’s Community Guidelines, explain disqualification for entries that violate them, and be followed when awarding prizes. YouTube also says a contest must comply with applicable federal, state, and local laws and must not misrepresent genuine platform engagement or suggest YouTube sponsors or endorses it.

Put these details in the rules
- Organizer’s name and contact method, beneficiary charity, prize description, and who is eligible, including any age, location, or other restrictions.
- How to enter, the no-purchase/no-donation entry route, the entry limit if any, and whether a donation has no effect on entry or odds.
- The opening and closing date and time, including the time zone, and the precise event that ends entry acceptance.
- How the winner will be selected, when and how they will be notified, how long they have to respond, how eligibility will be verified, and how the prize will be delivered.
- How entrant information will be collected and used, with a privacy notice that complies with applicable law.
- All platform disclosures and disclosures required by applicable law, including that YouTube is not a sponsor if the contest is on YouTube.
For the closing moment, choose a single time reference and display it consistently: for example, a written date and time in a named time zone paired with a visible countdown. Test the clock before entries open. This is practical event management, not a substitute for legal requirements. Do not extend the window, change eligibility, or substitute a different selection method once entries are open unless the published rules expressly allow it and applicable law permits it.
Can people enter by donating?
For a US sweepstakes-style giveaway, keep donation and entry independent: offer a genuine free entry route, do not require a donation, and do not give donors extra chances or improved odds. The FTC’s guidance is that sweepstakes requiring a purchase are illegal in the United States. Do not assume this resolves every raffle or chance-based promotion; state and local rules may impose additional restrictions, and the format may need legal review.

Make the free entry method practical and visible, not hidden behind the donation link. Explain it aloud and in the pinned message or on-screen card. A contribution can support the charity, but it should not be presented as the price of admission to a sweepstakes-style drawing.
Where does the donation money go?
Before asking anyone to give, explain the whole payment path in plain language. The FTC’s online giving portal guidance, dated June 2018, emphasizes that donors should understand who receives funds, what fees apply, when the charity gets the money, and whether donor details are shared. Put these facts next to the donation link and before the payment decision, not only in fine print.

Donation-route checklist
- Name the charity intended to benefit and accurately describe its relationship with any donation portal or intermediary.
- Identify who takes the payment first and who ultimately distributes it if that is not the charity itself.
- Disclose fees or percentages withheld and, where known, the net amount expected to reach the charity.
- State the expected transfer timing and what happens if a transfer is delayed or fails.
- Explain whether donor information is collected or shared with the charity or anyone else, and what choices donors have.
Compare donation routes on recipient and intermediary, fees and net proceeds, payout timing and failure handling, donor-data practices, and the charity’s authorization and ability to account for the funds. Verify these particulars in the portal’s current terms and with the charity; do not promise a transfer date or tax treatment you cannot substantiate.
How do you run the timed giveaway during the stream?
- Open with the terms. Name the beneficiary, explain the donation path, state the free entry route, and read the entry window and time zone. Keep the same information visible in a pinned message or on-screen card.
- Keep one clock. Use the time reference stated in the rules. Announce the deadline with its time zone and do not accept entries after the published closing moment.
- Close and select. Stop entries at the stated time, then use the selection method in the rules. Record when entries closed and how the result was selected so you can resolve questions consistently.
- Protect entrant data. Collect only information needed to administer the giveaway and use it as described in the privacy notice.
- Disclose platform relationships. On YouTube, do not imply YouTube is involved or endorses the giveaway. On Twitch, its branded-content guidance distinguishes independent charity fundraising from fundraising paid for by a charity or corporate partner: the latter requires use of Twitch’s branded-content tool. Check Twitch’s current policy and the event’s facts before relying on that distinction.
What should you do after the stream?
- Contact the selected entrant through the method and within the schedule in the rules. Confirm eligibility and arrange delivery of the prize under those terms.
- Report the donation total accurately. Distinguish amounts collected from fees deducted and funds still awaiting transfer; confirm the amount and timing with the donation provider or charity before describing money as received.
- Keep the published rules, charity authorization, donation-route details, entry and selection record, and prize-fulfillment record for follow-up and disputes.
What can go wrong, and how do you handle it?
- The countdown and stated deadline differ: stop using the inconsistent display, refer to the published rule and its time zone, and do not quietly extend entry. If an error materially affected participation, pause and seek appropriate legal advice before deciding how to proceed.
- A viewer thinks a donation is required: correct the impression on stream and in the pinned instructions, point to the free entry method, and review whether the donation call-to-action made the terms misleading.
- The portal’s payout or fees are unclear: verify the payment flow with the provider and charity before making further claims; report pending amounts as pending rather than as funds already received.
- The selected entrant does not respond or is ineligible: follow the published response period and alternate-winner or redraw procedure, if the rules include one. Do not invent a new procedure after selection.
- Entrant information is exposed or used unexpectedly: stop unnecessary collection or sharing, follow the privacy notice and applicable obligations, and use only the information needed to administer the prize.
- A platform policy or local requirement is uncertain: check the platform’s current official rules and obtain advice for the relevant jurisdictions before accepting entries or donations.
