The person or business promoting the giveaway—not the streaming platform—must handle compliance, selection, prize delivery, and any required disclosures.
Plan the prize, eligibility, and entry process
Choose a prize you can supply and fulfill. For a shirt or hoodie, decide the design, available sizes and colors, eligible shipping regions, who pays postage, and what happens if the selected item or size is unavailable.
Before you announce the giveaway, settle the details entrants need to know:
- Who is eligible, including any age or geographic limits and any exclusions you choose to apply.
- When entries open and close, and whether each person may enter once or more than once.
- How to enter and any platform-account requirements.
- Whether the winner is selected at random or judged, and the criteria if judged.
- How and where the winner will be contacted, how long they have to respond, and how an alternate will be selected if they do not claim the prize.
- What the prize includes and how it will be delivered.
Make the rules match the procedure you will actually use. A chat keyword can be simple, but specify the entry window, how duplicates or ineligible entries are handled, and the draw method. Do not promise one method and use another.

Publish rules before taking entries
For a YouTube contest, YouTube requires official rules and makes the creator responsible for compliance and prize administration. The rules must include legally required disclosures, a privacy notice, and language stating that YouTube is not sponsoring the contest and releasing it from contest liability. They must also link to YouTube’s Community Guidelines. YouTube requires free entry, prohibits contests through ad units, and bars manipulating views, likes, dislikes, or subscribers. It also says not to request full rights or ownership of an entrant’s submission. Review YouTube’s contest policies before launch; creators remain responsible for applicable federal, state, and local law.
U.S. rules can depend on the entry mechanics, prize, geography, and whether the winner is chosen by chance or skill. FTC small-business guidance says purchase-required U.S. sweepstakes are illegal and notes that state law may require disclosures, licensing, or a bond. See the FTC advertising FAQs for small businesses. These sources do not provide a universal rules template, so seek jurisdiction-specific advice when the promotion’s scope or mechanics warrant it.

For a Twitch promotion, the promoter is responsible for applicable legal compliance, rules, winner selection, prizes, expenses, and any required registrations or bonds. Twitch may remove a promotion it believes violates its terms or the law. Twitch requires this disclaimer to be displayed or read aloud: “This is a promotion by [Your Name]. Twitch does not sponsor or endorse this promotion and is not responsible for it.” Check the current Twitch Terms of Service before running the promotion.
Run the giveaway during the livestream
- Explain the offer. State the prize, eligibility limits, entry instructions, close time, winner-selection method, and where viewers can read the rules. On Twitch, include the required platform disclaimer.
- Keep entry consistent with the rules. On YouTube, entry must be free. Do not tie entries to views, likes, dislikes, or subscriber counts.
- Close entries on time. Stop accepting entries at the announced time and use the selection method you published.
- Announce the next step. Tell viewers how the selected entrant will be contacted and where they should respond. Do not expose private shipping information in chat.
If a brand sponsors the giveaway or provides the merch, disclose that relationship clearly. FTC guidance says livestream endorsement disclosures should be repeated periodically so viewers who join partway through see them. Twitch also requires use of its branded-content tool when applicable; the tool does not replace the creator’s legal responsibilities. Consult the FTC’s influencer disclosure guidance and Twitch’s branded-content policy.

Contact the winner and deliver the merch
- Contact the selected entrant through the channel named in your rules.
- Verify only the eligibility details your rules said you would verify.
- Give the winner the stated claim deadline. If they do not respond, follow the alternate-winner procedure you published.
- Collect any needed size, color, and shipping details privately. Explain how you will use and retain that information, then follow your notice.
- Ship the prize, keep an administration record consistent with your rules, and, if you announce completion, do so without sharing the winner’s private details.
YouTube requires an appropriate privacy notice. Ask only for details needed to fulfill the prize; apparel may require a size, color, and shipping address. Never ask entrants to post addresses in public chat.

Whatnot’s native giveaways
Whatnot describes free standard giveaways, follower-only giveaways, and buyer-appreciation giveaways. Entries happen in the app, random winners are announced during the show, and the seller pays shipping. The formats have different mechanics and availability; use Whatnot’s rules for Whatnot, not as a template for YouTube or Twitch. Its help page was dated September 30, 2026. See Whatnot.

Common mistakes to avoid
- Announcing before the rules are ready: publish the rules and privacy notice before inviting entries.
- Changing the draw after entries close: follow the stated selection method, entry limits, and deadlines.
- Requiring a purchase on YouTube: YouTube requires free contest entry; U.S. purchase-required sweepstakes also raise legal concerns.
- Collecting addresses in public: request delivery details privately and only from the winner.
- Forgetting late-arriving viewers: repeat material sponsorship disclosures during the stream.
- Treating another platform’s giveaway format as universal: platform-specific mechanics and obligations differ.
