Berry later received songwriting credit and publishing royalties.
Which Chuck Berry song was involved?
The song was Berry’s “Sweet Little Sixteen,” the model for the Beach Boys’ “Surfin’ U.S.A.” The Los Angeles Times reported that “Surfin’ U.S.A.” reached No. 3 on the Billboard Hot 100 in 1963 and quoted Wilson saying, “I just took ‘Sweet Little Sixteen’ and rewrote it into something of our own.” He characterized the result as an homage. The Associated Press likewise described the Beach Boys song as closely modeled on Berry’s recording. Los Angeles Times; Associated Press
Why did the song become a dispute?
Berry’s publisher argued that the resemblance went beyond tribute and amounted to plagiarism. The dispute ended with writing credit and publishing royalties transferred to Berry. Retrospective accounts sometimes summarize this as Berry successfully suing for credit, and a federal appellate dissent recounts that he was credited as songwriter beginning in 1966. Those accounts establish the credit and rights outcome, but not a court judgment deciding the infringement claim on its merits. Los Angeles Times; Associated Press; Federal appellate opinion
What did Mike Love say about the lyrics?
In a Rock Cellar interview, Mike Love said: “I wrote all the words and I consciously crafted it to be different than Chuck Berry’s ‘Sweet Little Sixteen’ although it is derivative because of the structure of the song and the way it goes.” That is Love’s account of his lyrical role; the interview alone does not settle the songwriting history.
