There is no single Oklahoma office identified in official sources as the investigator for every complaint against a county sheriff. The right route depends on whether you are reporting a suspected crime, raising a certification issue, seeking an official’s removal, questioning county spending, or challenging a public-records denial. Those processes have different decision-makers and powers; submitting a complaint to one does not automatically start another.
Who investigates complaints against a county sheriff in Oklahoma?
It depends on what happened and what outcome you are seeking. A criminal allegation, a concern about a peace officer’s certification, an allegation of official misconduct, a question about county expenditures, and a denied records request are not interchangeable complaints. Oklahoma’s official sources describe different routes for them, rather than a universal sheriff-oversight office.
| Concern | Relevant body or process | What it can do—and an important limit |
|---|---|---|
| Possible crime | An appropriate law-enforcement agency or district attorney; the Oklahoma State Bureau of Investigation (OSBI) may assist | OSBI usually begins work at the request of an authorized official or body. A public complaint to OSBI does not itself compel an investigation. |
| Peace-officer certification or regulated status | Council on Law Enforcement Education and Training (CLEET) complaint portal | The portal accepts complaints about licensed or certified individuals or entities; that does not make CLEET the investigator for every allegation against an elected sheriff. |
| Qualifying official misconduct and possible removal | Attorney General investigation followed, if the statutory conditions are met, by an ouster case decided by a court | This is a formal statutory process, not an ordinary complaint form, and an allegation does not itself remove an officer. |
| County accounts, bills, disbursements, or expenses | County commissioners, under 19 O.S. § 340 | They may investigate specified fiscal matters and subpoena witnesses for that inquiry; the authority is not a general power to decide every misconduct allegation. |
| Denial of access to public records | Oklahoma Attorney General’s Public Access Counselor | The complaint process reviews access disputes, not the underlying conduct described in the requested records. |
| State ethics issue | Oklahoma Ethics Commission, only for matters within its jurisdiction | The Commission says it does not handle local political-subdivision employees’ conflict-of-interest matters; the exact issue and the official’s status matter. |
The next step is to name the specific act or decision you want reviewed—not simply to choose the office with the broadest-sounding title. A single incident can raise more than one kind of issue, but each process has its own authority and purpose.
How to report a suspected crime
If you believe the sheriff or someone in the sheriff’s office committed a crime, report the suspected conduct to an appropriate law-enforcement agency or district attorney. Give a factual account and preserve material that may help establish what happened. Avoid treating an OSBI submission as a guaranteed request for an investigation.

OSBI describes itself as a limited-jurisdiction agency. It says that, aside from exceptions where it has original jurisdiction, most of its investigations begin at the request of another law-enforcement or governmental entity. Its listed requestors include law-enforcement officers, district attorneys, the Attorney General, and the Governor, among other officials and bodies. The agency also lists areas of original jurisdiction, including vehicle theft, oil-field theft, computer crimes, threats to public officials, and violent crimes on the turnpike. That list is not exhaustive; check OSBI’s current pages for the full scope and current intake guidance: OSBI history and jurisdiction and Investigative Services Division.
In practical terms, a person reporting a suspected crime can provide information to law enforcement or a prosecutor, while an authorized agency or official may request OSBI assistance where appropriate. The fact that OSBI can investigate a type of offense, or that a citizen has information about one, should not be confused with a public right to direct OSBI to open a case.
When CLEET may be relevant
CLEET’s Portal Links & Forms page has a “Complaints” section and states that members of the public may submit complaints about licensed or certified individuals or entities. This can make the portal relevant when the concern is specifically about a peace officer’s certification or regulated status.

Before filing, describe the connection between the conduct and the person’s licensed or certified status as clearly as you can. CLEET’s portal listing does not establish that the agency investigates every allegation against a sheriff in the sheriff’s capacity as an elected county officeholder. Nor does a certification complaint substitute for reporting a suspected crime, pursuing an applicable court process, or seeking a remedy for a records denial. The portal does not, by itself, promise a particular finding or outcome.

Official misconduct and a possible ouster case
Oklahoma’s Title 51 provides a formal route for investigating certain allegations of official misconduct and seeking removal from office. The statute makes county officers subject to removal proceedings. It defines official misconduct to include a willful failure or neglect to diligently and faithfully perform a duty imposed on the officer by state law. Whether particular conduct meets that definition is a legal question, not something established merely by labeling a complaint “misconduct.”
Under 51 O.S. § 94, the Attorney General has a duty to investigate when directed by the Governor or after receiving written, verified notice from at least 15 reputable county residents. If the Attorney General finds reasonable cause, the statute calls for an ouster proceeding in the Oklahoma Supreme Court or an appropriate district court. The court—not the complainant or the Attorney General acting through an intake form—decides the case. Consult the official Oklahoma Statutes PDF for current statutory text and requirements before relying on a filing procedure.

This is not the same as a criminal prosecution, a certification review, or a civil lawsuit. It is also not an ordinary complaint route with a simple promise that a filing will produce a hearing. The statutory requirements are specific; a person considering a verified notice should check the current law and seek qualified legal advice about the form, verification, and other procedural requirements rather than assume that an informal letter is sufficient.
A real example illustrates the difference between requesting an investigation and proving misconduct. On April 21, 2023, Governor Kevin Stitt wrote to Attorney General Gentner Drummond concerning McCurtain County Sheriff Kevin Clardy. The Governor invoked § 94, asked the Attorney General to investigate alleged official misconduct, and urged ouster proceedings if reasonable cause were found. The letter records a request and its legal framing; it is not a finding that the allegations were true or evidence that every complaint follows that path. The Governor’s April 21, 2023 letter reproduces the statutory definition as “Any willful failure or neglect to diligently and faithfully perform any duty enjoined upon such officer by the laws of this state.” For current legal wording, rely on the applicable statute rather than the historical letter alone.

When the concern is about county money—such as an officer’s accounts, disbursements, bills, or expenses—19 O.S. § 340 gives county commissioners authority to inquire into and investigate those matters. The statute also allows commissioners to subpoena witnesses for that inquiry. It is a fiscal and administrative oversight power, not a general sheriff-misconduct tribunal.

That distinction matters when a complaint combines an expense concern with an allegation of criminal conduct or dereliction of duty. Commissioners’ statutory inquiry into county accounts does not, by itself, determine criminal guilt, direct a prosecution, or remove the sheriff. For the provision’s text, see 19 O.S. § 340. If your concern is about a specific payment or bill, identify the transaction, date, amount if known, and the records or explanation at issue; do not assume the fiscal inquiry resolves any separate allegation.
What to do if the sheriff’s office denies public records
A dispute about access to records has its own route. The Oklahoma Attorney General’s Public Access Counselor complaint process addresses alleged wrongful denials of public-records requests. The page says the unit conducts an initial review; complaints it considers meritorious are forwarded to the public body or official for review and response. That is a records-access process, not an investigation into the conduct that the records might describe.
Keep the original request, the response or denial, and any follow-up correspondence together. In your complaint, identify the public body, the records sought, when and how you requested them, and what response you received. Those details help frame the access dispute. The Counselor’s published process does not guarantee that a complainant will receive the requested records or that an unrelated allegation will be investigated.

Ethics complaints: check the jurisdiction first
The Oklahoma Ethics Commission handles specified state ethics matters. It says it does not have jurisdiction over local political-subdivision employees’ conflict-of-interest matters and directs people with a county-employee concern to the relevant county ethics agency or human resources department. See the Commission’s File a Complaint page for its stated scope.
Do not assume that every issue involving a sheriff is a matter for the Commission or that a county-specific concern necessarily fits the employee guidance on its page. An elected sheriff’s status and the precise allegation can affect the jurisdictional analysis. Check the Commission’s current instructions and the appropriate local process for the particular issue before filing.
How to prepare a useful complaint
There is no single universal sheriff complaint form in the official sources described here, so tailor what you submit to the receiving body’s current instructions. A clear, organized account makes it easier to understand what you are alleging and which authority you are asking to act.
- State the conduct precisely. Describe what happened, when and where it happened, who was involved if known, and what you personally observed. Separate firsthand observations from information someone else provided.
- Identify the issue and requested action. Say whether you are reporting a suspected crime, asking about certification review, raising an official-misconduct concern, flagging a county expenditure, or disputing a records denial. If more than one issue exists, distinguish them rather than asking one office to resolve everything.
- Organize supporting material. List available documents, photographs, recordings, messages, transaction records, or witness names and explain what each item relates to. Preserve originals and avoid altering files. Do not assume that a submission to one office automatically reaches another.
- Use the designated channel and follow its current requirements. For a records complaint, use the Public Access Counselor process; for a certification-related concern, consult CLEET’s portal; for other routes, verify the receiving office’s intake instructions. A general complaint form is not a substitute for a specialized procedure.
- Keep a submission record. Save a copy of what you sent, when you sent it, and any confirmation or response. If the matter is urgent or there is an immediate danger, contact emergency services or an appropriate law-enforcement agency rather than waiting for a complaint process.
These are practical organization steps, not a statement that every office requires every item. Do not send unnecessary sensitive information, and do not publish unverified allegations as established fact. If a filing could affect legal rights, a deadline, or an active case, obtain advice from a qualified attorney.
What the Attorney General’s general complaint form can—and cannot—do
The Attorney General also offers a Citizen Complaint Form. It may be an intake option for matters that do not fit a specialized route, but it is not a dedicated sheriff-misconduct portal. The form says the office does not guarantee an investigation or inquiry and is not the complainant’s private attorney. Use the process that matches the actual issue when one exists, and do not infer that submission creates an attorney-client relationship or compels the office to act.
Which route should you choose?
- Someone may have committed a crime: report the suspected offense to an appropriate law-enforcement agency or district attorney. OSBI’s involvement generally depends on an authorized requestor unless the matter falls within its original jurisdiction.
- The issue concerns peace-officer certification: review CLEET’s public complaint portal and describe the certification-related concern without assuming it covers every elected-official allegation.
- You seek removal for official misconduct: understand Title 51’s Attorney General and court process, including the statutory trigger for investigation and the court’s role in an ouster case.
- The concern is county spending: look to the commissioners’ limited statutory inquiry over county officers’ accounts and expenses.
- The sheriff’s office denied records: use the Public Access Counselor complaint process for the access dispute, keeping it separate from the underlying conduct.
- The concern is an ethics matter: confirm that the Ethics Commission or a relevant county process has jurisdiction over that specific issue.
Official agency pages and statutory text can change. Before filing, check the linked authority’s current instructions and the current version of any statute that controls your issue. This matters especially for formal legal proceedings: a historical example, a general complaint form, or an older copy of a law should not be treated as a current filing guide.
