Helmet Man: Andrew Ainsworth and the Original Stormtrooper Helmet Lawsuit

Andrew Ainsworth made 50 production Stormtrooper helmets after Lucas approved his prototype. The UK Supreme Court rejected Lucasfilm’s English claim that the helmets were sculptures, but Lucasfilm had already secured a US judgment.

Andrew Ainsworth made the production Stormtrooper helmets for Star Wars after George Lucas approved his prototype. Years later, Lucasfilm sued over Ainsworth’s sales of helmet and armour replicas. Ainsworth prevailed on the English copyright issue that reached the UK Supreme Court—but Lucasfilm had already obtained a judgment against him in the United States, so this was not a worldwide victory.

Who made the original Stormtrooper helmets?

The helmets emerged from several people’s contributions, not a single creator’s. George Lucas conceived the story and characters. Ralph McQuarrie’s drawings and paintings gave visual form to Lucas’s idea of threatening figures in “fascist white armoured suits.” Andrew Ainsworth then translated that concept into three dimensions.

Ainsworth made several prototype helmets using vacuum moulding. After Lucas approved the final version, Ainsworth made 50 helmets for use in the film, according to the UK Supreme Court’s 2011 press summary. The trial judge described the Stormtroopers as “one of the most abiding images in the film.”

Why did Lucasfilm sue Ainsworth?

Lucasfilm claimed copyright in artistic works created for the films and had developed a licensing business that included Imperial Stormtrooper models. In 2004, Ainsworth used his original tools to make helmet and armour versions for public sale. The Supreme Court’s press summary reported that goods worth between $8,000 and $30,000 were sold in the United States.

Lucasfilm obtained a judgment against Ainsworth in the United States and also pursued proceedings in England. Those English proceedings included claims under English and US copyright law. By the time the case reached the UK Supreme Court, Lucasfilm’s remaining English claim was that the helmets were “sculptures” and therefore protected as artistic works under English copyright law.

What did the UK Supreme Court decide?

In Lucasfilm Limited and others v Ainsworth, [2011] UKSC 39, decided on 27 July 2011, the Court rejected the claim that the helmets qualified as sculptures under section 4 of the Copyright, Designs and Patents Act 1988. That was a decision about the legal category applicable to the helmets for this English copyright claim—not a finding that Lucasfilm had no rights of any kind, or that replicas could be sold freely everywhere.

The Court also addressed a separate question: whether an English court can hear a claim alleging infringement of foreign copyright. It held that an English court may adjudicate such a claim when it has personal jurisdiction over the defendant. That jurisdiction ruling did not change the outcome of the distinct question about whether the helmets were sculptures under English law.

Why “and won” needs a UK qualifier

The headline is accurate only when tied to the English copyright issue decided by the UK Supreme Court. Ainsworth won the argument that the helmets were not sculptures for the relevant English claim. But Lucasfilm had also obtained a US judgment against him, as the Supreme Court’s press summary records. The available summary does not establish the amount or full terms of that US judgment, so the often-repeated dollar award should not be treated as a figure verified by the UK Court.

UK claim at the Supreme Court The helmets did not qualify as sculptures for the English copyright claim under the Copyright, Designs and Patents Act 1988.

What the ruling does—and does not—mean

The dispute turned on both territory and legal classification. The English Supreme Court considered whether the helmets fell within the statutory category of sculpture for an English copyright claim, while separately considering when English courts can hear foreign copyright claims. Its ruling should not be read as a general license to reproduce film props or as a ruling that copyright protections are identical across countries.

A 2016 Tech Times profile adds biographical details beyond the Court’s account: it says Nick Pemberton approached Ainsworth to make a prototype, describes his earlier model and prop work, and reports that Ainsworth later sold replicas through the Shepperton Design Studios shop. Those are details reported by that profile, not findings set out in the Supreme Court press summary.
