George Carlin’s estate and the creators behind the Dudesy podcast settled the lawsuit over George Carlin: I’m Glad I’m Dead. The agreement required the hourlong special to be permanently removed and barred future use of Carlin’s image, voice or likeness without the estate’s express written approval. The settlement’s other terms were not disclosed, and no court decided whether the special was unlawful.
What the settlement required
The agreement, filed in federal court in early April 2024, required permanent removal of the special and prohibited future use of Carlin’s image, voice or likeness without express written approval from his estate. Public reports did not disclose a payment amount or other financial terms. The underlying agreement and a final court order were not directly available in the reported materials, so the publicly established terms are limited to those reported.
Kelly Carlin, the comedian’s daughter, said she was pleased the matter was resolved quickly and amicably, and thanked the defendants for removing the video. Her statement was reported by the Associated Press on April 2, 2024.
How the lawsuit unfolded
- January 9, 2024: Dudesy released the hourlong George Carlin: I’m Glad I’m Dead on YouTube, presenting it as an imitation of Carlin created by the Dudesy AI character.
- January 25, 2024: Main Sequence, Ltd. and estate executor Jerold Hamza filed suit in the U.S. District Court for the Central District of California. The named defendants included Dudesy, LLC, Will Sasso and Chad Kultgen.
- Early April 2024: The parties settled, and the agreement’s reported terms required the special’s permanent removal and restricted future use of Carlin’s identity without written estate approval.
The complaint alleged copyright infringement and violation of Carlin’s right of publicity. Those descriptions are allegations in the filing, not findings by a judge. The complaint is available as Case 2:24-cv-00711, Document 1.

What is known about AI’s role
A spokesperson for Sasso later said the Dudesy AI character was fictional and that Kultgen wrote the special, according to The Guardian’s April 3, 2024 report. Because the case settled before discovery, the precise role of AI in generating the script or performance was not established in court. The available reporting therefore does not establish that an AI model was trained on Carlin’s material.
Did the Carlin settlement set a legal precedent?
No. A settlement resolves a dispute between the parties; it is not a merits judgment. The court did not decide whether the special infringed copyright, violated publicity rights, or qualified as parody or transformative expression. The agreement may be cited in discussion of similar disputes, but it does not establish a court rule for them.

The legal questions are related but distinct:
- Copyright: Whether protected material was used unlawfully is a question about the source works and how they were used.
- Right of publicity: This concerns unauthorized commercial use of a person’s identity, including after death where the applicable law provides for it.
- First Amendment and transformative use: Courts may weigh expressive protections against publicity claims, including whether a work adds significant creative elements beyond a mere likeness or imitation.
A May 2024 background paper from the California State Assembly committee says California Civil Code section 3344.1 provides a damages action for unauthorized commercial use of a deceased personality’s name or likeness within 70 years of death. It also describes the transformative-use approach and emphasizes that applying legal principles to new technologies is case-specific. These are general legal context, not rulings in Carlin’s case. The paper states that the parties settled and that the media company agreed to remove the routine and cease using Carlin’s image, voice or likeness without permission. The agreement set concrete limits for the defendants: remove this special and do not use Carlin’s image, voice or likeness without the estate’s written approval. It did not resolve broader questions about AI-generated impersonations, copyright, publicity rights or parody for other creators and cases. Estate attorney Joshua Schiller described the agreement as a “blueprint” for similar disputes, as reported by the AP; that was his characterization of the settlement, not a court conclusion.
