What happened on the train
The Los Angeles Times reported that MTA police responded on the morning of Sept. 18, 2025, to a disorderly-passenger report at the Fordham Metro-North station in the Bronx. The newspaper quoted the department’s account: a conductor said a 31-year-old passenger occupied two seats and refused to move his feet from one.
According to the department, body-camera and on-board security footage showed O’Keefe stretching both legs across an adjacent seat. Police alleged that he refused officers’ directions to leave the train and board a following one, and said the incident delayed service by six minutes. Those are claims attributed to the department as reported by the Times; the newspaper report, rather than the underlying footage or a directly reviewed agency release, is the available source for them.
O’Keefe described the complaint differently. In his account, a woman told him to change how he was sitting, and she complained to the conductor after he refused. He alleged that the complaint and the police response reflected racial bias. The Times also reported his claim that a friend of the woman said, “You’re not the minority anymore.” These are O’Keefe’s allegations, not findings established by the court disposition reported later.

Why accounts of the removal differ
O’Keefe characterized the encounter as an arrest. The MTA Police Department said he was handcuffed, removed from the train, issued a disorderly-conduct summons, and allowed to take a later train, but that he “was not placed under arrest at any time.” The distinction matters: the reported account describes a summons and removal, while the department expressly denied that he was arrested.
The Times reported that New York City Transit rules can treat occupying more than one seat and placing a foot on a seat as disorderly conduct. That context does not establish which account of the seating encounter is accurate, nor does it mean the dismissal changed or invalidated those rules.

The summons was dismissed in October
A New York City administrative judge dismissed the civil summons on Oct. 7, 2025, according to the Los Angeles Times report published the next day. The Times said O’Keefe described the summons as “facially insufficient.” The Independent separately reported that his attorney, Lindsay Lewis, said the court dismissed the disorderly-conduct violation and terminated the case.
The available reporting establishes the outcome as dismissal of the summons. It does not establish a judicial finding that O’Keefe was racially profiled, or a broad ruling on transit seating rules. O’Keefe’s statement, reported by the Times, “Sitting while Black is not illegal,” was his own characterization—not a quotation from the judge.

How to read the competing accounts
- O’Keefe’s account: His description of the woman’s complaint, the alleged remark by her friend, and racial bias comes from his public account as reported by news outlets.
- The police account: The department’s description of the seating, refusal to follow directions, delay, and non-arrest status was reported by journalists quoting the department; it is not the same as independently reviewed footage.
- The court outcome: News reports say the summons was dismissed. That disposition resolves the summons but, based on the available reporting, does not decide the disputed allegations about motive or establish a general rule about seating.
