Eagles Lyrics Trial: Don Henley Ends Testimony With Jabs and Jokes

Henley said he lent lyric drafts to Ed Sanders for research, while the defense argued the defendants could sell papers acquired through Sanders. Prosecutors later dropped the case without a verdict on ownership.

Don Henley finished his third day of testimony on February 28, 2024, in the New York criminal trial over handwritten Eagles lyric drafts. He said he had let writer Ed Sanders consult the pages for research, not keep or sell them. The defense argued that the defendants acquired the papers through Sanders and could sell them. The case ended without a verdict on ownership: prosecutors dropped the criminal charges on March 6 after late disclosure of thousands of pages of communications.

What happened on Henley’s final day of testimony?

On Wednesday, February 28, Henley concluded three days on the witness stand. The criminal case concerned roughly 100 handwritten pages associated with the Eagles’ 1976 album Hotel California and other songs. In Rolling Stone’s courtroom account, Henley was handed envelopes and identified lyric pads and drafts, including material connected to “After the Thrill Is Gone” and songs from The Long Run.

The day included exchanges that gave the testimony its lighter headlines. As he wrapped up, Henley said, “I’m losing my voice,” according to Rolling Stone’s February 29 report. The jokes and jabs were courtroom color; the consequential question remained whether the pages had been lent for research or transferred for the defendants to sell.

What did Henley say about the lyric pages?

Henley testified that the pages were his and that he had not given them away. “I always knew those lyrics were my property. I never gifted them or gave them to anybody to keep or sell,” he said, as reported by the Associated Press on February 28, 2024. That was Henley’s account, not a court finding that he owned the papers.

His testimony placed the dispute in the context of Sanders’s work on an authorized, unpublished Eagles biography. Henley said he allowed Sanders to examine lyric pages for research and expected him to return them. Reporting said the biography work began in 1979 and continued through the band’s 1980 breakup. Henley testified that he disliked an early manuscript; in a 1983 letter, he praised a later draft as one that “flows well and is very humorous up until the end,” according to the AP account. A favorable comment on a manuscript, or access to the pages, does not by itself establish that Sanders was given ownership or permission to sell them.

How did the defense describe the papers’ provenance?

The defense’s competing account was that the defendants acquired the pages through Sanders and had the right to sell them. The core disagreement was what Sanders’s access meant and whether the chain of custody showed a transfer of ownership or only temporary access for biography research.

Why were the charges dropped?

On March 6, 2024, Manhattan prosecutors dropped the criminal case midtrial after late disclosure of around 6,000 pages of communications involving Henley, his lawyers, and associates. Assistant District Attorney Aaron Ginandes told the court that the delayed material contained relevant information the defense should have had an opportunity to explore while Henley and other prosecution witnesses testified, according to the Associated Press’s March 6 report.

That procedural end was not a jury acquittal, and it did not establish that the defendants owned the lyric sheets. The criminal charges ended without a verdict resolving the underlying ownership dispute.

  • 1979 onward: Sanders worked on an authorized but unpublished biography of the Eagles.
