Why did the judge dismiss Drake’s lawsuit?
On October 9, 2025, U.S. District Judge Jeannette A. Vargas dismissed the suit. The central issue was whether a reasonable listener would take the song’s challenged lyrics as communicating verifiable facts about Drake. “Although the accusation that Plaintiff is a pedophile is certainly a serious one, the broader context of a heated rap battle, with incendiary language and offensive accusations hurled by both participants, would not incline the reasonable listener to believe that ‘Not Like Us’ imparts verifiable facts about Plaintiff.”
The opinion also discusses the elements of New York defamation, including a defamatory statement of fact about the plaintiff, publication, falsity, the applicable fault standard, injury, and the absence of privilege. It addresses the heightened actual-malice requirement that applies to public figures. The dismissal’s core reasoning was about how a reasonable listener would interpret the song in context; it was not a finding that every accusation in the lyrics was true.

What is known about the appeal?
Drake said he intended to appeal, according to Associated Press reporting published on October 9, 2025. An appellate filing dated January 21, 2026 confirms that review was underway by then. The filing is available as DktEntry 35.1 in case 25-2758.
Those records establish that Drake appealed, but they do not establish the appeal’s later status or disposition as of October 8, 2026. The Second Circuit says that post-2010 appeals are maintained in its CM/ECF system, with access linked through PACER; consult its docket guidance to check the live case record. Without that later docket information, it would be inaccurate to say the appeal is still pending or has been decided.

Does Drake have a chance of winning?
There is a legal path to appellate review, but Drake’s position starts from an adverse district-court ruling: Judge Vargas concluded that the song would not be understood by a reasonable listener as conveying verifiable facts about him. That conclusion creates a substantial obstacle. An appellate court can review the legal analysis, but the available case materials do not support a reliable numerical estimate of Drake’s chances or a definitive prediction of the outcome.
The key distinction is between whether the lyrics are offensive or serious and whether they would be understood, in context, as actionable statements of fact. The district court resolved that issue against Drake. Until the latest appellate docket and any decision are verified, the accurate assessment is limited: Drake lost at the district-court stage and appealed; the result of that appeal is not established here.
