The available reporting and case records describe competing accounts—not a court finding that Oyer was fired for her position.
What does Oyer say happened?
In March 2025, contemporaneous reporting described Oyer’s account: she declined to recommend that Gibson be included in a memo concerning people being considered for restoration of federal firearm rights, and she was later fired. Oyer believed the dispute contributed to her removal. DOJ disputed that causal explanation, according to the same reporting.
The distinction matters: the reported disagreement concerned a recommendation about whether Gibson should be included among candidates for consideration. The reporting does not establish that Oyer had authority to restore his rights herself, that a restoration was approved, or that her refusal was the proven reason for her firing.
What has DOJ said, and what is established?
DOJ has denied that the Gibson disagreement caused Oyer’s removal. That denial conflicts with Oyer’s account; neither side’s account is a judicial finding. The available record does not resolve the motive for her firing.

In October 2026, The Daily Beast reported a further allegation from an inspector-general complaint by Oyer. She alleged that Associate Deputy Attorney General Paul Perkins told her domestic-violence offenders could not be excluded from the restoration process because Gibson needed to receive relief. The report quoted her complaint as saying: “Ms. Oyer was advised by Mr. Perkins that domestic violence offenders could not be excluded because it was necessary to grant relief to Mel Gibson.”
Perkins denied making that statement. The Daily Beast quoted him: “I never told her—or anyone else—that domestic violence offenders could not be excluded from the restoration process because it would be necessary to grant relief to Mel Gibson.” The complaint and denial add a disputed allegation about how the broader program was shaped; they do not prove why Oyer was fired.

Where do Oyer’s cases stand?
Oyer’s litigation page lists separate administrative and federal proceedings. Because that page is maintained by a litigant, it is a primary account of her cases, not a neutral finding on the disputed events.

What is the federal firearm-rights restoration program?
On August 17, 2026, DOJ announced a final rule and a staged process under 18 U.S.C. § 925(c). The statute allows the Attorney General to restore federal firearm rights in qualifying cases. DOJ says the decision is individualized: applicants must satisfy the Attorney General that their circumstances, record, reputation and later conduct show they are not likely to endanger public safety, and that relief would be consistent with the public interest.

DOJ described the prior statutory process as effectively unavailable to most applicants for more than three decades. Its announcement called the new program a pathway for “30 million Americans” who have lost Second Amendment rights. That figure is DOJ’s estimate, not an independently validated count in the sources available here.
Rollout dates announced by DOJ
DOJ’s August 17 announcement scheduled an initial stage for invited candidates beginning September 25, 2026, followed by public stages on November 4, 2026, and January 4, 2027. As of October 8, 2026, the first date had passed and the two public-stage dates were still in the future. These are the dates DOJ announced; availability and timing may change.

Eligibility is not automatic
The final rule sets presumptive disqualifiers and an extraordinary-circumstances route. For a misdemeanor crime of domestic violence, the rule provides a ten-year lookback during which applicants generally must demonstrate extraordinary circumstances, subject to additional specified conditions. That is not the same as a categorical lifetime ban, nor does it make restoration routine. Applicants remain subject to the rule’s other criteria and individualized review.
Any relief under the federal program applies to relevant federal disabilities only. DOJ says it does not override separate restrictions imposed by state law, so a federal restoration would not by itself settle a person’s status under every state’s laws.

How does the new program relate to the firing dispute?
The Gibson-related recommendation reported in 2025 and DOJ’s general restoration program announced in 2026 are connected in the public dispute, but they are not the same decision. The later program’s rules and rollout provide policy context; they do not establish that Gibson received relief, that Oyer’s refusal caused her removal, or that the alleged Perkins statement was made. Those questions remain contested in the accounts described above.
