What the Ayodhya court dismissed
Additional Civil Judge (Senior Division)/ACJM Ekta Singh dismissed the complaint filed by Shivendra Singh under Section 210 of the Bharatiya Nagarik Suraksha Sanhita (BNSS). The court found that the complaint was not maintainable and that the complainant did not have locus to file it. [Source] [Source]
The ruling addressed that complaint. It did not determine whether Rathore’s posts constituted an offence, nor did it dispose of the separate police case in Lucknow.

The two proceedings had different procedural paths: one was a private complaint dismissed by an Ayodhya court, while the other was a police FIR whose investigation was allowed to continue.

What the later courts said about the Lucknow FIR
Allahabad High Court: investigation could continue
On September 19, 2025, a division bench of the Allahabad High Court rejected Rathore’s petition to quash the FIR. The court noted that freedom of speech and expression under Article 19(1)(a) is subject to reasonable restrictions, and concluded that the allegations and case diary justified investigation at that stage. It said it would not comment on the merits while the investigation was ongoing and expected it to be fair, independent, impartial, and conducted according to law. [Order] [Source] [Source]

“Prima facie” describes a preliminary assessment. The High Court’s refusal to quash the FIR was a procedural decision permitting investigation to proceed, not a finding that Rathore committed an offence.

Supreme Court: no opinion on the merits
On October 13, 2025, the Supreme Court declined to interfere with the High Court order. It expressly left the merits open and said Rathore could raise objections at charge-framing or seek discharge at the appropriate stage if a chargesheet had been filed. [Order]

Anticipatory bail application
On December 5, 2025, an Allahabad High Court single judge rejected a separate anticipatory-bail application. The order left Rathore’s remedies under law open; it was not a decision on whether she was guilty. [Order]

What is known about the FIR’s current status
The December 5, 2025 anticipatory-bail order is the latest procedural development established by the sources cited here. They do not establish whether a chargesheet has since been filed, whether charges have been framed, whether a discharge application has been decided, or whether a trial is underway. The FIR’s status after that order should therefore not be described as resolved.
