Trump’s May 2025 announcement was a directive to begin work on a 100% tariff on movies produced abroad—not an enacted tariff with published rules. The White House said the next day that no final decision had been made, and the later reporting and official tariff-action listing cited here do not show the proposal taking effect. The idea could make overseas production more expensive for U.S. distributors, but it left basic questions unanswered: what counts as a foreign movie, whether streaming is covered, and how a movie’s value would be assessed.
What did Trump announce—and did the tariff take effect?
On May 4, 2025, Trump said he was authorizing the Commerce Department and the Office of the U.S. Trade Representative to begin the process of instituting a 100% tariff on movies “produced in Foreign Lands.” The Associated Press reported his statement and the White House’s response the following day: “Although no final decisions on foreign film tariffs have been made, the Administration is exploring all options to deliver on President Trump’s directive to safeguard our country’s national and economic security while Making Hollywood Great Again.” AP’s report on the announcement makes clear the administration had not settled the policy.
The USTR’s presidential tariff-actions listing does not list a foreign-film tariff, and AP later reported that the threat had not been imposed despite a renewed threat in September 2025. That record supports describing the measure as a proposal or threat, not a current tariff. An omission from a listing alone is not conclusive proof of the absence of any related action, and tariff status can change.
Why the proposal is a blockbuster mistake
1. It announced a process, not workable rules
The May statement set out a headline-grabbing target and a 100% rate, but it did not include operating text or a tariff schedule explaining how the measure would work. The White House’s statement that no final decision had been made underscored that the basic policy remained unsettled.

2. “Foreign-produced” is not a simple category
A movie may have U.S. financing, a U.S. studio, international cast and crew, overseas locations, and postproduction in more than one country. The announcement did not say whether origin would turn on where filming occurred, who financed or owned the movie, or some combination. Shooting location alone would not answer who is responsible for a levy or which films it covers. Contemporaneous reporting described the uncertainty around defining a foreign film.
3. Streaming leaves the border—and the taxable event—unclear
A physical film print or disc can cross a customs border; a movie licensed for online viewing does not arrive in the same way. The announcement did not explain whether a streaming release would count as an import, or how a tariff would apply to it. Contemporaneous reporting identified streaming coverage as an open question, so it would be premature to claim that the proposal either did or did not cover streaming.

4. It did not explain what “100%” would be charged on
A rate does not determine the bill unless the taxable value is defined. The announcement did not say whether a movie would be valued using a production budget, licensing fee, box-office receipts, or another measure. Those are possible bases, not established rules. Without a defined valuation method and import definition, distributors and studios could not reliably calculate exposure.
5. U.S. companies and workers could face collateral costs
International productions connect American studios and workers with overseas crews, locations, and production services. A levy on incoming movies could therefore affect U.S. businesses involved in financing, licensing, distribution, or exhibition, rather than landing only on foreign producers. The cited reporting does not quantify those effects, so they are a risk—not a proven number of lost jobs or a measured cost.

6. A tariff does not establish a fix for production moving abroad
Foreign tax credits and rebates are among the incentives competing for productions, while concerns about the level of production in the United States are a separate issue. Reporting documented that context but did not establish that a tariff on foreign movies would bring production or jobs back. Penalizing finished films entering the country is not, by itself, evidence that U.S. shoots would become more competitive.
7. The U.S. industry has exports worth protecting
The Washington Post reported Motion Picture Association figures of $22.6 billion in U.S. film and television exports and a $15.3 billion trade surplus for 2023. Those figures describe the sector’s trade position; they do not prove that this proposal would cause a particular loss. But they show why a policy aimed at foreign movies should also consider potential effects on U.S. companies selling entertainment abroad and the possibility of retaliation. The Washington Post’s coverage attributes the figures to the MPA.

8. The national-security rationale lacked an operational explanation
Trump characterized foreign production incentives as a national-security threat. Contemporaneous reporting, however, said the administration had not explained how the tariff would operate or identified a specific legal basis for it. That leaves a gap between the stated rationale and a policy that could be administered consistently. The reporting cited here does not establish a court ruling on this proposal.
9. Support for U.S. production is not support for this tariff
SAG-AFTRA said it supported efforts to increase movie, television, and streaming production in the United States and create good middle-class jobs. That position supports the goal of more domestic work; it should not be read as an endorsement of a 100% tariff. The union’s statement addressed production and jobs, not approval of this particular instrument.

What a better-targeted policy would need to answer
Any proposal intended to increase U.S. production should be judged by whether its design can be administered and whether it can demonstrate results—not simply by its stated goal. A serious comparison would ask:
- What does it target? Production location, ownership, or a specific business practice are different policy choices.
- Can it show measurable results? The relevant test is a demonstrated effect on U.S. production and jobs, not an assumption that a tariff will create them.
- What are the trade risks? The U.S. industry exports films and television, so retaliation and effects on overseas sales matter.
- Can it be administered lawfully and consistently? The policy needs a defined legal basis, a clear origin test, and a workable way to assess value.
- How does it treat streaming and co-productions? Global financing and online distribution make a simple foreign-versus-domestic line difficult to apply.
- Who bears the cost? Studios, workers, distributors, exhibitors, and viewers could face different consequences.
The evidence available for this proposal does not establish that a tariff would achieve the goal of more U.S. production. It does show why a rate announced without definitions, valuation rules, or a clear account of coverage would leave major questions unresolved.
