The FCC’s Media Bureau put late-night and daytime talk shows on notice in January 2026. In a public notice dated January 21, 2026, it said the agency had not been presented with evidence that the interview portion of any talk show then on air would qualify for the bona fide news exemption from the equal-time rule. That is a change in the agency’s stated position, not an amendment to the rule’s text, and the available reporting does not show a final ruling against any talk show.
The notice has already had practical effects. Over the following months, two late-night hosts handled interviews with the same Texas candidate, James Talarico, in ways that the hosts and their networks tied to equal-time concerns. This article separates what the FCC has put in writing from what hosts, networks and a candidate have said about it.
What the equal-time rule requires
The rule comes from Section 315 of the Communications Act. When a broadcast station permits a legally qualified candidate for public office to use its facilities, the station must give that candidate’s opponents an equal opportunity to use the same station. Three features matter for talk shows:
- The trigger is a candidate’s use of the station. The question is whether a legally qualified candidate was given a platform on the broadcast, not whether the program is political in tone.
- It applies to broadcast, not streaming or internet programs. AP’s account of the dispute describes the equal-opportunities provision as covering broadcast television, not online distribution.
- It has exemptions for bona fide news. Newscasts, news interviews and on-the-spot coverage of bona fide news events can fall outside the equal-opportunities requirement. Whether a talk-show interview fits that exemption is the central question in the current dispute.
Why the exemption is not automatic
The FCC’s position is that the exemption depends on the applicable facts and criteria. A talk show cannot assume that an interview with a candidate is covered simply because it airs in a news-adjacent format.

The 2006 Leno precedent
In 2006 the FCC’s Media Bureau found that the interview portion of The Tonight Show with Jay Leno qualified for the exemption in the circumstances before it. The guest was Arnold Schwarzenegger, then a candidate for California governor. The decision shows that a late-night interview can qualify. It does not show that late-night interviews as a category are exempt, because the finding turned on the particular program and facts in front of the bureau.
What the January 2026 notice says
The notice, released by the Media Bureau on January 21, 2026, is the agency’s most explicit statement on talk shows. It says the FCC had not been presented with evidence that the interview portion of any late-night or daytime talk show then on air would qualify for the bona fide news exemption. It does not say that every talk-show interview is disqualified. It treats the question as fact-specific.

The notice is also guidance, not a rule change. Contemporaneous coverage and a response from Commissioner Anna Gomez both treated it as a Media Bureau interpretation rather than a rule adopted by a Commission vote that changed the rule’s text. Guidance signals how the agency intends to read the rule. It is not the rule itself.
How the 2006 and 2026 matters compare
The two matters differ on the factors that decide whether the exemption applies, and on what kind of action the agency has taken.

How the 2026 episodes unfolded
Colbert and Talarico, February 2026
AP reported that Stephen Colbert said CBS executives pulled his February 2026 interview with James Talarico over concerns about equal-time provisions. CBS said it had not prohibited the interview from being broadcast. The interview was posted online, and AP reported that the YouTube version had more than 7.5 million views. Talarico reported raising $2.5 million in campaign donations in the 24 hours that followed. Those are reported results for one episode. They do not measure how often the rule changes booking decisions.
The View and Carr’s enforcement statement
After Talarico appeared on ABC’s The View, the FCC was investigating the program. AP quoted Chairman Brendan Carr saying, “The FCC has an enforcement action underway on that.” That is a statement that an action was in progress. It is not a finding that the program violated the rule, and the available reporting does not describe one.

Kimmel’s September decision
In September, Jimmy Kimmel said his planned interview with Talarico would not air on broadcast television. It would instead be made available on YouTube. Kimmel said the FCC had threatened his show and network. The Texas Tribune quoted him as saying:
“Now that he is president, his FCC has threatened me, threatened our show, threatened our network ABC, our affiliates, our local stations based on simple traditional editorial decisions: guest bookings it would seem they don’t like.”

AP’s report of the same remarks notes that Kimmel did not elaborate on the grounds the FCC cited. Neither report identifies the specific communication he described as a threat. These are his characterizations. They are allegations, not findings of a formal order.
The broadcast-only scope of the provision explains why the online route mattered. Because the equal-opportunities requirement reaches broadcast stations, publishing the interview on YouTube moved it outside that requirement, as AP describes it. That describes the reduced broadcast exposure. It does not mean that posting the interview online triggered the same broadcast obligation.

Coverage of these episodes often blends guidance, investigation and enforcement. Four stages separate them:

What remains open
- Court testing. Whether the 2026 interpretation would survive a legal challenge has not been tested in the reporting.
- Formal rulemaking. Nothing in the available reporting describes a Commission rulemaking to change the rule’s text.
- Daytime programs. The notice covers daytime talk shows as well as late-night programs, but the concerns behind the The View inquiry are not described in the reporting.
- Retaliation claims. Allegations of political retaliation or censorship connected to these episodes have not been adjudicated.
- Measured effect. The reporting cites no systematic study of how the rule affects late-night bookings. The Colbert and Kimmel episodes are individual cases, not a measure of the rule’s general effect.
