PleasrDAO quoted the remark in a 2024 lawsuit alleging that Shkreli kept and shared album files after the sole physical copy was forfeited and sold. A federal judge later ordered him to turn over copies and identify recipients in a preliminary injunction, not a final ruling on every claim.
What Shkreli said about the album
On a video-recorded podcast on May 13, 2024, Shkreli said he had “burned the album and sent it to like, 50 different chicks[.]” PleasrDAO quoted the statement in its verified complaint, paragraphs 41–45. The complaint also quotes him asking, “You think I didn’t make a fucking copy of it? Are you joking?”
The figure of 50 came from Shkreli’s own description. The complaint does not establish that exactly 50 people received files, and the sources cited here do not provide an independently verified recipient count. The complaint also recounts other statements in which Shkreli claimed thousands had listened, said he sent MP3s, and posted that he played the album in his Discord. Those remain allegations and reported statements, not an audited accounting of who received or heard the music.
Why the album was meant to be different
Wu-Tang Clan conceived Once Upon a Time in Shaolin as a single-copy work. Shkreli bought it in 2015 for $2 million. A federal court opinion says the purchase agreement gave him a 50 percent interest in copyrights and renewal copyrights in the recordings and compositions, while setting 88-year limits on duplication and exploitation, subject to specified exceptions.

The agreement allowed private duplication, according to the court’s description. Other duplication or exploitation was restricted apart from defined exhibition and related uses. That distinction matters: the dispute is not simply whether Shkreli ever had a right to make a copy. PleasrDAO alleged that keeping or distributing files after the album’s forfeiture and sale violated the protections governing it; Shkreli’s reported position was that he made copies while he owned the album and was allowed to do so under the agreement. The court opinion is available here.
How the sole physical copy changed hands
Shkreli forfeited the album after his criminal conviction. The U.S. Department of Justice said the government sold the sole physical copy on July 27, 2021, with proceeds to satisfy a forfeiture money judgment of approximately $7.4 million. The DOJ’s announcement said the buyer and price were confidential under the sale contract; it does not confirm either. See the DOJ release.

PleasrDAO sued in June 2024. Its complaint alleged that Shkreli retained copies and shared or streamed the album after he had forfeited it and the physical copy had been sold. It cited his podcast remarks, posts, and a June 9, 2024 X Spaces session that the complaint said drew 4,900 listeners. These are details presented by the plaintiff, not an independent count of file recipients or listeners.

On August 26, 2024, a federal judge in Brooklyn issued a preliminary injunction. Ars Technica reported that it barred Shkreli from possessing, using, disseminating, or selling interests in the album, including its data, files, or contents. The order also required him to turn over copies, swear that he no longer possessed any, identify recipients with contact details, and say whether he had received money. A preliminary injunction is interim relief; it does not by itself resolve all claims at trial.
The legal disagreement centers partly on what the purchase agreement permitted when Shkreli owned the album and what obligations applied after forfeiture and sale. A later legal analysis reported that the court allowed trade-secret claims to proceed past the motion-to-dismiss stage. That procedural ruling was not a final finding that Shkreli was liable. What is established—and what remains unresolved
- Established in court and government records: Shkreli bought the album for $2 million in 2015; the agreement described a 50 percent copyright interest and 88-year usage restrictions; and the government sold the sole physical copy in 2021.
- Attributed claims: Shkreli said he sent copies to “like, 50” people; PleasrDAO alleged that he retained and distributed files after forfeiture. Neither establishes an exact recipient total.
- Interim court action: The August 2024 preliminary injunction required turnover and recipient disclosure while the dispute proceeded.
- Not established by the cited sources: the case’s final outcome, a verified count of recipients, or the DOJ-confirmed identity and price of the 2021 buyer.
