Those were defense claims, not findings. In November 2025, the Nevada Supreme Court denied Davis’s request for extraordinary relief, ruling that dismissal was not the proper procedure for challenging the evidence and that Davis had not shown the claimed federal agreement bound Nevada or covered later interviews.
Why did Keffe D file a motion to dismiss?
On January 6, 2025, Davis’s attorney, Carl Arnold, filed a motion seeking dismissal of the charges, according to The Associated Press. The defense advanced three main arguments:
- Delay and prejudice: The motion characterized the time between the 1996 shooting and Davis’s prosecution as a 27-year delay and argued it had irreversibly harmed his ability to defend himself.
- Corroboration: The defense argued the state lacked corroborating evidence. This was an assertion by Davis’s lawyers, not a judicial finding about the trial evidence.
- Immunity agreements: The defense alleged federal and local authorities had failed to honor agreements protecting Davis’s statements.
Arnold told AP, “The prosecution has failed to justify a decades-long delay that has irreversibly prejudiced my client.” He also argued that the alleged failure to honor immunity agreements undermined the prosecution. District Attorney Steve Wolfson, by contrast, said the evidence was strong and that jurors would decide whether to believe Davis’s accounts, AP reported.
What did the Nevada Supreme Court decide about the motion?
On November 4, 2025, the Supreme Court of Nevada denied Davis’s original petition for a writ of mandamus, which challenged the district court’s denial of his motion to dismiss. The court did not conduct a trial of the factual claims or rule that every disputed issue had been resolved. Its decision addressed whether extraordinary relief was warranted and explained the procedural limits of the motion. The court said dismissal was not the route to contest evidence sufficiency
The court noted that the record before it did not include the indictment or grand jury transcript, which made it difficult to evaluate the charges and arguments. It also explained that a motion to dismiss an indictment was not the appropriate way to challenge whether the state had enough evidence to support the indictment. Under Nevada procedure, an objection to the evidence sustaining an indictment is raised through a habeas petition. A conviction, in turn, may be challenged on direct appeal.
The court did not find Nevada bound by the claimed federal agreement
The order acknowledged the district court’s determination that Davis made statements subject to a federal proffer agreement in 1998. But the Supreme Court said Davis had not shown that the agreement’s protections extended to later law-enforcement interviews or that Nevada was bound by it. That is a narrower ruling than a finding that no agreement existed: the court addressed what Davis had established in the record before it and denied mandamus relief.

Was the Tupac murder case dismissed?
No. The motion did not end the prosecution, and the Nevada Supreme Court’s November 2025 order denied Davis’s request for mandamus relief rather than dismissing the indictment. The order addressed the procedural challenge; it was not a verdict on guilt or a full adjudication of every defense allegation.

What happened in the case afterward?
AP reported that Davis pleaded not guilty to one count of murder with a deadly-weapon allegation and an allegation concerning intent to promote, further, or assist a criminal gang. Prosecutors accused him of orchestrating and enabling the shooting; AP’s account did not allege that Davis personally fired the shots. Tupac Shakur was shot in Las Vegas on September 7, 1996, and died six days later. The case drew on Davis’s statements and interviews, as well as his 2019 memoir, Compton Street Legend, which was admitted as evidence at trial.
As of October 8, 2026, the Matter of Record case tracker reports that a jury returned a guilty verdict on August 31, 2026, and lists sentencing for October 13, 2026. The tracker says court minutes are pending and that it did not verify the sentencing date against the Clark County Odyssey docket. Rev’s transcript page, dated September 1, 2026, provides additional context about the verdict proceedings. Because the official minutes and docket date were not confirmed in those materials, the verdict and scheduled sentencing should be understood as reported updates, not independently verified court-record details.
