Donald Trump’s 2025 statements about delaying the TikTok ban were part of a series of pauses in federal enforcement—not a repeal of the law. His administration later described a proposed U.S. joint-venture framework, and TikTok announced in January 2026 that its U.S. joint venture had been established. Those are separate stages, and the later arrangement should not be confused with the repeated extensions.
What Trump meant by delaying the TikTok ban
The Protecting Americans from Foreign Adversary Controlled Applications Act set restrictions involving the distribution, maintenance, or updating of covered applications, including TikTok. On January 20, 2025, Trump directed the attorney general not to enforce the Act for 75 days while his administration considered what to do.
Trump’s order did not repeal or amend the statute. It directed a temporary pause in federal enforcement. In Executive Order 14166, Trump wrote: “I hereby order the Attorney General not to take any action on behalf of the United States to enforce the Act for 75 days from the date of this order, to permit my Administration an opportunity to determine the appropriate course of action with respect to TikTok.” Read Executive Order 14166.

What the proposed deal and later joint venture changed
The White House proposal in September 2025
In a September 25, 2025 fact sheet, the White House said Trump had determined that a proposed U.S.-based joint venture framework would qualify as a “qualified divestiture.” The White House described majority U.S. investor ownership, a U.S.-based board, ByteDance ownership below 20%, and Oracle as the security provider. These were the administration’s stated terms for its proposed framework; the fact sheet alone does not establish that every feature had been implemented. Read the White House fact sheet.

TikTok’s January 2026 announcement
On January 23, 2026, TikTok announced that TikTok USDS Joint Venture LLC had been established. TikTok said the arrangement enabled more than 200 million Americans and 7.5 million U.S. businesses to continue using its community. Those audience and business figures are TikTok’s own published numbers, not independent measurement. The company announcement is evidence of the announced establishment of the joint venture; it should not be treated as proof that each detail in the earlier White House proposal was implemented exactly as described. What the July 2026 government-device opinion does—and does not—say
On July 16, 2026, the Justice Department’s Office of Legal Counsel published an opinion concerning the No TikTok on Government Devices Act and the TikTok USDS Joint Venture. Its subject is that government-device law. It is not a general ruling that resolves every legal or policy question about TikTok, nor should it be read as eliminating restrictions on all government devices or addressing personal-device availability in general. How to read the headline now
- Delay: Trump’s orders instructed the executive branch not to enforce the Act for specified periods.
- Proposed framework: In September 2025, the White House described a proposed arrangement it said met the law’s qualified-divestiture standard.
- Announced joint venture: TikTok said the U.S. joint venture was established in January 2026.
- Separate government-device issue: The July 2026 OLC opinion addressed a law restricting TikTok on government devices, not every question about TikTok’s broader availability.
So the headline describes Trump’s 2025 posture: he was willing to keep postponing federal enforcement while a resolution was pursued. It is not, by itself, a current deadline notice, a repeal of the statute, or a complete account of the later corporate arrangement.
