Trigg Kiser, 3, drowned in May 2025 in the backyard pool at his family’s home in Chandler, Arizona, and died the following day at a hospital. Chandler police recommended one Class 4 felony child-abuse charge against his father, Brady Kiser. On July 25, 2025, the Maricopa County Attorney’s Office announced that he would not be charged. The backlash that surfaced in 2026 concerns a different incident: a photo of the couple’s 16-month-old on a boat without a life jacket, which his mother, Emilie Kiser, apologized for.
Timeline of the case
The sequence below separates the pool drowning, the two charging decisions, and the later boat-photo controversy, which is a separate event.

Two separate decisions: a police recommendation and a prosecutorial decision
Chandler police recommending a charge is not the same as a charge being filed, and neither is a finding of guilt. The recommendation went to the Maricopa County Attorney’s Office, which makes the charging decision. That office then decided not to proceed.
In its July 25, 2025 statement, the office set out the legal standard it applied. It said that to convict on this charge, the state must prove beyond a reasonable doubt, to a unanimous jury, that the person failed to perceive a substantial and unjustifiable risk, and that this failure was a gross deviation from the standard of care a reasonable person would show.

“After careful review of the evidence submitted by Chandler PD, it was determined this case does not meet that standard.”
That is the office’s stated legal standard and its decision. It is not a court ruling, and no court has found anyone responsible for Trigg’s death.

What is not public
The county attorney’s office said its review included surveillance footage showing how the drowning occurred, along with the timeline of events. It also said that a court order prevents it from discussing additional details, stating: “Given a court order, no additional details can be discussed at this time.”
Readers should treat the following as outside what is established. The police report and the footage are not publicly available in the reporting reviewed here, so claims about what the video shows are unverified. There is no sourced basis for attributing a motive to the family, and no sourced basis for a legal conclusion beyond the county attorney’s stated decision not to charge.

Emilie Kiser’s public statements
Emilie Kiser’s first post after the death came in August 2025, roughly three months after it. ABC News quoted her as writing: “Loss of this magnitude feels impossible to put into words. I’ve spent days, weeks, months trying to find them and also take the time I’ve needed to digest the loss of my baby.”
The 2026 life-jacket backlash is a separate incident
The controversy that drew criticism in 2026 involved a boat outing with the Kisers’ younger child, not the pool where Trigg drowned. NBC News reported on August 15, 2026 that Emilie Kiser apologized for a photo showing her 16-month-old on a boat without a life jacket. She called it a lapse in judgment that she deeply regretted. NBC also reported that she had posted regularly about water safety after returning to social media.

The boat photo should not be read as a comment on how Trigg died. Life-jacket guidance applies to natural water, and it does not establish that a life jacket would have prevented a backyard-pool drowning.

- A four-sided fence at least four feet high that fully encloses the pool and separates it from the house and yard.
- A self-closing, self-latching gate.
- Close, constant supervision of children near water.
CDC states that a four-sided isolation fence separating the pool from the house and yard reduces a child’s drowning risk by 83% compared with three-sided property-line fencing. This is CDC’s comparison from its 2026 guidance, not a guarantee of safety and not a finding about the Kiser home.
Swimming lessons can reduce risk, but CDC says children who have had lessons still need close and constant supervision. CDC also recommends learning CPR and says floaties and water wings are not drowning-prevention devices.
Life jackets for natural water
For lakes, rivers, and other natural water, CDC recommends a properly fitted, fully fastened U.S. Coast Guard-approved life jacket. Fit and fastening matter as much as approval: a jacket that is too large, or left unbuckled, does not offer the protection it is designed to provide.

The figures below are national or population-level estimates. Each carries its own date range and population, and none describes an individual case.

These numbers describe the wider problem of child drowning. They cannot tell readers what happened in the Kisers’ backyard, which remains the subject of a court order and a non-charging decision.
