What Did Ben Foster Do in Netflix’s Worst Ex Ever? The True Story

The man featured in Worst Ex Ever was convicted in a 2019 Nevada case. Separate Oregon charges in 2023 were never tried before his death.

Ben Foster, whose full name is Benjamin Obadiah Foster, was convicted in Nevada for holding a girlfriend captive and abusing her in 2019. In January 2023, Oregon police sought him on attempted-murder, kidnapping and assault charges after a separate attack in Grants Pass. Foster died after a standoff before the Oregon charges went to trial, so they were never adjudicated.

Who is Ben Foster in Worst Ex Ever?

Foster is the man featured in the first episode of the 2024 season of Netflix’s Worst Ex Ever. Netflix’s episode description says the story follows Justine’s friend Angie as she arrives at Justine’s home, discovers a terrible scene and sets off a statewide search for Foster. The series presents the case through survivor, family and investigator accounts.

What happened in the 2019 Nevada case?

According to the Associated Press’s 2023 report, Foster held his then-girlfriend captive in her Las Vegas apartment for about two weeks. The AP reported that he broke seven of her ribs, gave her two black eyes, choked her until she lost consciousness and forced her to eat lye. These details are the AP’s account of the abuse and cited authorities, not a substitute for the underlying court record.

Conviction and sentence

The Nevada case resulted in a conviction after a plea deal. The AP reported that Foster received a sentence of one to 2½ years and was released on October 21, 2021, with credit for 729 days he had spent in jail before sentencing. That account does not mean he served the full term in state prison.

What was Foster accused of in Oregon?

In January 2023, Grants Pass police responded to a residence and found a woman bound and severely beaten unconscious, according to the police department’s release. The woman was hospitalized in critical condition. This was a separate incident involving a different woman from the Nevada case.

Police sought Foster on attempted-murder, kidnapping and assault charges. The AP reported that prosecutors described the attack as intentional torture and secret confinement. Those descriptions concern the Oregon allegations; Foster was not tried or convicted in that case.

How did the search end?

Police reported a standoff and said Foster was taken into custody. The AP reported that he died from a self-inflicted gunshot wound after being transported to hospital. Because he died before trial, the Oregon charges remained unresolved rather than becoming convictions.

What the series covers—and what it does not establish

Netflix’s dated 2024 Tudum coverage describes the first-season episode through Angie’s discovery and the search that followed. Netflix’s catalog listing currently lists two seasons, but season count and streaming availability can change by date and region. The episode is a documentary account, while the legal outcome differs between the two cases: Nevada ended in a conviction; Oregon ended without a trial.
