The Pitt is the subject of a contract lawsuit brought by the estate of ER creator Michael Crichton. The estate alleges that the series grew out of a proposed ER reboot whose negotiations fell apart; the defendants say The Pitt is a new and original show. A February 2025 court ruling allowed the case to proceed past an early procedural challenge, but did not decide whether the series is legally derivative of ER.
Who is suing whom, and what does the lawsuit claim?
Roadrunner JMTC LLC, successor-in-interest to the John Michael Crichton Trust, sued Warner Bros. Television, WarnerMedia Direct, John Wells Productions, John Wells, Noah Wyle and R. Scott Gemmill. The complaint asserts breach of contract, breach of the implied covenant of good faith and fair dealing, and intentional interference with contractual relations. These are allegations in the estate’s lawsuit, not findings that the defendants violated the contract.
The estate says The Pitt is a derivative work restricted by Crichton’s agreement concerning ER, and that he was entitled to appropriate credit. The defendants contest that premise and argue that the contract cannot bar them from making any show about emergency medicine.
How does the estate say the dispute developed?
The estate’s public chronology describes a proposed ER follow-up that ultimately became the point of contention. Its website says John Wells and Wyle began collaborating on a reboot in February 2020; the project expanded to include Gemmill and other ER contributors in 2021; it was pitched to networks in July 2022; and negotiations with the estate began in December 2022. According to the estate, Wells told it in October 2023 that the reboot was dead, and Warner Bros. announced The Pitt in March 2024. This is the estate’s account of events, not a court-verified finding of every date or interpretation.

The complaint alleges that the creative team worked on a proposed follow-up, that negotiations over permission and credit later failed, and that The Pitt was then made without the estate’s consent. The court’s later ruling recounted evidence of communications, negotiations, their failure and the show’s creation, but did not resolve the underlying dispute over the parties’ agreement.
What do the shows share, and how do they differ?
The comparison is not limited to the fact that both series take place in emergency medicine. Noah Wyle and John Wells are associated with both shows, and Gemmill worked on ER before creating The Pitt. The estate argues that the connection goes beyond a shared genre; the defendants emphasize the shows’ differences. Whether any of these similarities or differences matters under the contract remains unresolved.

The estate-maintained ER Lawsuit website describes ER as running for 15 seasons and 331 episodes, and reports 124 Emmy nominations and 23 wins. Those figures come from the estate’s anniversary-era coverage, rather than an independent awards tally here.
What did the court decide in February 2025?
On February 24, 2025, Los Angeles Superior Court Judge Wendy Chang denied the defendants’ anti-SLAPP motion. The court found that the plaintiffs had met the minimal-merit threshold required at that procedural stage, based on evidence the court was required to accept as true for purposes of the motion.

That ruling was not a decision that The Pitt copied ER, nor did it establish that the estate had won the lawsuit. The judge expressly wrote: “The Court cannot determine the ultimate question of whether or not The Pitt is, in fact, derivative of ER within the meaning of the Agreement through this motion.” The central contract question therefore remained undecided in that ruling.
What have the defendants and Noah Wyle said?
Warner Bros. Television called the lawsuit baseless and said The Pitt is “a new and original show,” adding that any suggestion otherwise is false and that it intended to defend the claims. That is the company’s position, not a judicial conclusion.

Wyle, who is associated with The Pitt and starred in ER, told TVLine in April 2025: “The only thing that I can legally speak to is how I feel emotionally, which is just profoundly sad and disappointed.” He also said, “This taints the [ER] legacy, and it shouldn’t have.”

The February 2025 anti-SLAPP ruling establishes only that the claims survived that early challenge; it does not settle liability or the meaning of the contract. The available reporting described an appeal and activity through mid-2026, but a case-specific appellate docket or final disposition has not been established here. No definitive claim about the lawsuit’s current outcome should be inferred from the trial court’s ruling.
