Actor James Hunter alleged in a lawsuit that Mia Goth kicked him in the head while he was working as a background actor on MaXXXine in April 2023. Goth, director Ti West and studio A24 denied the allegations in court filings, according to reporting. The lawsuit remains an allegation—not a finding of liability—and the latest located procedural report, from September 2026, concerns Goth’s request to give a deposition remotely.
What Hunter alleged happened on the MaXXXine set
Hunter’s complaint, as described by The Guardian, says he was a background actor covered in fake blood and lying on the ground as if dead in a scene in which Goth was supposed to step over him. Hunter alleged that, after he warned Goth she was close to him, she intentionally kicked him in the head during a subsequent take.
The complaint’s wording, reproduced by The Guardian, says: “In the following take, defendant Goth intentionally kicked plaintiff in his head with her boot.” That is Hunter’s allegation as stated in his filing; it is not an independently established account or a court finding.
Injuries and alleged consequences
Hunter alleged that he had an immediate headache and neck stiffness, was later diagnosed with a concussion, and continued to experience symptoms. These are claims reported from the complaint, not independently verified medical findings. He also alleged that he was not retained for the remaining shoot dates after the incident.

Who sued, and what claims were reported?
Hunter sued Goth over an alleged battery and brought wrongful termination claims involving Goth, director Ti West and A24, according to Variety and The Guardian. The claims concern alleged conduct on the production and Hunter’s reported loss of work; the complaint’s allegations do not establish that any defendant was legally responsible.
How the defendants responded
Variety reported in July 2024 that Goth, West and A24 denied Hunter’s allegations in court filings. An A24 representative told Variety that the claims were “simply not true” and said the studio would defend the filmmaking team. This is the defendants’ position, not a judicial determination that the allegations are false.

What the latest reported lawsuit update says
In a report dated September 23, 2026, TMZ said Goth filed a declaration asking to give her deposition by videoconference. The report described her as concerned about being near Hunter and citing privacy concerns. TMZ also said she did not object to being deposed and had previously denied wrongdoing.
TMZ quoted the declaration as saying: “Based on my awareness of [James’] conduct in connection with this litigation, I am concerned that his interest in me extends beyond the issues being litigated in this case.” This was Goth’s stated concern in support of her remote-deposition request; it is not a finding about Hunter or the merits of the suit.

What is not established by that update
The September 2026 report describes a request, but does not establish whether a judge granted it, whether the deposition took place, or whether the lawsuit was later resolved. The reporting cited here therefore does not establish a final case outcome.
