That allegation was not a court finding. On May 20, 2025, a federal judge dismissed the operative complaint, allowing limited amendment of some claims while dismissing others with prejudice.
What the lawsuit alleged about the concert
The case arose from Madonna’s Celebration Tour performance at the Kia Forum in Inglewood, California, on March 7, 2024. Justen Lipeles and other plaintiffs brought a putative class action. The Guardian reported that Lipeles’s complaint alleged that topless women simulated sex acts on stage and characterized the content as “pornography without warning.” Those descriptions are allegations attributed to the plaintiff, not established facts or a court’s description of the performance. The Guardian’s May 31, 2024 report also described claims about the advertised start time and the venue being too hot.
What the court decided
In Lipeles et al. v. Madonna Louise Ciccone et al., No. 2:24-cv-04896-MWC-SSC, the U.S. District Court for the Central District of California issued an order on May 20, 2025, granting defendants’ motion to dismiss and denying their alternative motion to strike the class allegations. The ruling addressed the third amended complaint, which plaintiffs had filed on March 21, 2025. The court’s May 20, 2025 order allowed the plaintiffs to amend specified claims by June 6, 2025, and dismissed other claims with prejudice.
Why some claims were dismissed
For claims under California’s False Advertising Law and Unfair Competition Law, and for negligent misrepresentation, the court found that the complaint did not adequately allege an omission contrary to a representation or a duty to disclose. It also concluded that the alleged omission about venue temperature did not concern the service’s central functionality and was not pleaded with the required specificity. Those conclusions concerned the complaint then before the court; they were not a final ruling on every possible amended claim. The order permitted amendment of certain consumer-protection, negligent-misrepresentation, and negligence claims.

What is and is not established about the case now
The May 20, 2025 order is the documented procedural status here: the operative complaint was dismissed, with leave to amend some claims by June 6 and other claims dismissed with prejudice. The available record does not establish whether plaintiffs filed another amended complaint by that deadline or what later happened on the docket. The order therefore should not be read as a finding that the alleged sexual content did or did not occur, nor as proof that the entire action was ultimately closed.
