The lawsuit over Madonna’s delayed December 2023 concert in Brooklyn ended in June 2024, when the plaintiffs voluntarily dismissed it with prejudice. Madonna’s representatives and Live Nation had said they would “defend this case vigorously” and attributed the delay to a technical issue during soundcheck. The court did not rule on whether the late-start allegations were true.
Why was Madonna sued over a late concert?
The case, Fellows et al. v. Ciccone et al., concerned the December 13, 2023, Celebration Tour show at Barclays Center in Brooklyn. Michael Fellows and Jonathan Hadden filed it on January 17, 2024, in the U.S. District Court for the Eastern District of New York. The defendants named in the original case caption included Madonna Louise Ciccone, Live Nation entities and Brooklyn Events Center, LLC, which does business as Barclays Center. According to the complaint, the concert was advertised to start at 8:30 p.m., but Madonna took the stage around 10:45 to 11 p.m. The plaintiffs alleged breach of contract and deceptive practices, and said the late finish disrupted their transportation and made it harder to get up for work. Those were claims made in the complaint, not facts established by a court.
What did Madonna and Live Nation say about the delay?
In a joint statement reported by The Guardian, Madonna’s management and Live Nation said, “We intend to defend this case vigorously.” They attributed the delay to “a technical issue 13 December during soundcheck.” That was their explanation for the late start, not a judicial finding about its cause.

Was the late-start lawsuit dismissed?
Yes. The procedural record shows that defendants filed a motion to dismiss on May 31, 2024. The plaintiffs filed a notice of settlement on June 7, but on June 10 the court found that no settlement had been agreed to and struck the notice. On June 19, the plaintiffs filed a voluntary dismissal with prejudice; the court entered an order dismissing the case on June 20. The docket chronology records these events.
“With prejudice” means the dismissed claims cannot be brought again in that action. It does not mean the court decided whether the concert began late as alleged, or whether the plaintiffs’ legal claims were valid.

Was the case settled?
The docket records that the court struck the earlier settlement notice after finding no settlement had been agreed to. Defendants’ attorney Jeff Warshafsky later told The Guardian that the dismissal “was not the result of any settlement.” The case ended with a voluntary dismissal, not a ruling resolving the underlying allegations. The Guardian reported the dismissal and the attorney’s statement.

The dismissal closed the case, but the cited court record does not show a decision on the merits. It therefore neither validates the plaintiffs’ account of the delay nor establishes the defendants’ explanation as fact. The lawsuit’s allegations and the soundcheck explanation remain attributed statements from the parties.
