What did R. Spencer Balentine allege?
Scroll.in reported on February 13, 2018, that Balentine had sued 20th Century Fox over the 2014 film, claiming it was based on The Keeper, a screenplay he wrote in 2003, rather than on the comic series the film was said to adapt. The report said he sought at least $5 million in damages. That figure was his reported demand, not an award or payment.
According to Scroll.in’s account of the complaint, Balentine pointed to elements including Knights of the Round Table, a small dog companion and holograms, and described similarities in character traits and plot. These were his allegations as relayed by the news report; they do not establish that the film copied his screenplay.
What was the film said to be based on?
Scroll.in described Kingsman: The Secret Service as an adaptation of the Kingsman comics franchise, written by Mark Millar and Dave Gibbons and published by Icon Comics, a Marvel imprint. The dispute therefore concerned two different claimed sources: the comic series identified as the film’s source and Balentine’s assertion that the film drew from The Keeper.

Was the film found to be based on Balentine’s screenplay?
The 2018 report establishes that Balentine made that allegation; it does not establish that a court accepted it. Law360’s case index identifies the suit as The Keepers Production LLC v. Twentieth Century Fox Film Corporation et al., case number 2:18-cv-01145, in the U.S. District Court for the Central District of California. The index information available here does not establish the case’s final disposition, so no conclusion about whether it was dismissed, settled or decided is warranted.
