Miller Gardner died on March 21, 2025, while vacationing with his family at Arenas Del Mar Beachfront & Rainforest Resort in Costa Rica. He was 14. The family announced his death two days later, initially saying he had fallen ill along with several family members, according to ESPN.
Early coverage should be distinguished from later findings. On March 25, 2025, The Independent described food ingestion as a preliminary possible explanation while autopsy and toxicology results were still awaited. ESPN later reported that Costa Rican authorities identified carbon monoxide as the cause of death on April 2, 2025, possibly from an adjacent machine room. The early explanation was preliminary; it is not the cause identified in that later report.
Why is Brett Gardner’s family suing the resort?
The family’s March 20, 2026, civil lawsuit, filed in Pennsylvania, names resort owners and operators, two Pennsylvania executives, their venture-capital firm, and connected Costa Rican companies, ESPN reported. The reported claims include wrongful death, gross negligence, and emotional distress.

The complaint alleges that a gas water heater in a mechanical room and inadequate ventilation allowed carbon monoxide to enter the Gardners’ adjacent rooms. It further alleges that defendants failed to act on warnings or provide appropriate safeguards. These are the family’s claims in a civil case, not findings that a court has established.
Michael Elsner, the family’s attorney, said: “Documents show they were warned and failed to implement simple changes for the safety of their guests. There must be accountability for these types of owner decisions.” That is the attorney’s characterization of the evidence and alleged decisions.

What is known about the investigation?
ESPN reported on March 20, 2026, that Costa Rica’s investigation remained ongoing and that no criminal charges had been filed as of that report. It also recounted prior reporting that a prosecutor had described the investigation as determining whether the death was homicide and, if so, who was responsible. A later raid reportedly gathered additional evidence, and a prosecutor said the investigation could lead to a manslaughter case. Those descriptions do not establish that a charge was filed or that anyone was found responsible.
The latest status established by the cited report is therefore time-limited: it describes the situation as of March 20, 2026, not necessarily today. No later official update or court complaint is established here.
