On July 25, 2025, the Maricopa County Attorney’s Office said it would not charge Brady Kiser in the death of his three-year-old son, Trigg, because prosecutors found no reasonable likelihood of conviction. Chandler police had recommended a child-abuse charge earlier that month, but a police recommendation is not a charge: prosecutors decide whether to file one.
What did prosecutors decide?
Maricopa County Attorney Rachel Mitchell announced on July 25, 2025, that her office would not charge Brady Kiser. The office said Chandler police had submitted the case for review earlier in July and recommended one count of child abuse, classified as a Class Four felony. The distinction matters: Chandler police’s recommendation was an investigative referral, not a filed charge or a finding of guilt. The county attorney’s office made the charging decision.
Why did the office say it would not file charges?
The office described the proof needed for conviction on the recommended charge as proof beyond a reasonable doubt, to a unanimous jury, that a person failed to perceive a substantial and unjustifiable risk and that this failure was a gross deviation from the standard of care a reasonable person would show. It said its review found no reasonable likelihood that the case would result in a conviction. That is the office’s explanation of its decision, not a complete statement of Arizona law.

The office said surveillance video from outside the home showed how the drowning occurred and the actual timeline, but it did not publicly describe further details. Its statement said: “Given a court order, no additional details can be discussed at this time.” The office attributed that limit to a court order; the public statement does not provide a basis for inferring more about the video or the evidence.
What is publicly established about the timeline?
The prosecutor’s statement said Trigg drowned in the family’s backyard pool in May 2025 while Brady Kiser was home alone with his two children. A verified court complaint filed on May 27, 2025, states that the drowning occurred on May 12 and that Trigg died on May 18. Those dates are attributed to the complaint. Read the verified complaint.

The available official statement does not provide a more granular account of what happened. Keeping to those attributed facts respects the limits the office identified and avoids speculation about a child’s death.
