Why Alcon sued Tesla and Musk
Alcon Entertainment, which says it holds the relevant copyright rights to Blade Runner 2049, filed its complaint in federal court in California on October 21, 2024. The lawsuit names Tesla, Musk and Warner Bros. Discovery as defendants and asserts copyright and related claims concerning film imagery and an alleged association between the film and Tesla’s promotion. Alcon alleges that the defendants sought permission to use an iconic still from the film to promote Tesla’s Cybercab. The event was livestreamed from Warner Bros.’ Burbank lot on October 10, 2024. What image appeared at the Cybercab event?
Alcon says a different image, which it alleges was generated using AI and resembled imagery from the film, appeared during Musk’s Cybercab remarks after the licensing request was rejected. The complaint says the image was displayed for about 11 seconds. The image’s production process and relationship to the film are allegations in the case materials, not established court findings. In its January 2026 opposition filing, Alcon said Musk referred to Blade Runner while discussing the futures depicted in science-fiction films. The filing quotes him as saying: “You know, I love ‘Blade Runner,’ but I don’t know if we want that future. I believe we want that duster he’s wearing, but not the, uh, not the bleak apocalypse.” This is the quotation as reproduced in Alcon’s court filing. Alcon’s opposition filing
What the February 2026 ruling did—and did not—decide
On February 6, 2026, Bloomberg Law reported that U.S. District Judge George H. Wu denied Tesla and Musk’s motion to dismiss Alcon’s direct copyright-infringement claim. Alcon may continue pursuing its theory that protected material was copied during creation of the event image, even if the resulting image itself is not substantially similar to the film. This was a ruling on whether the claim could proceed, not a decision after trial that Tesla or Musk infringed copyright. It did not resolve the merits of Alcon’s allegations, whether the use qualifies as fair use, or ultimate liability. The sources cited here do not establish a later order, settlement, appeal or trial result.

The case involves two related but distinct questions: whether protected film material was allegedly used while creating the image, and whether the resulting image displayed at the event infringed Alcon’s rights. The February 2026 ruling allowed Alcon’s pleaded direct-infringement theory to move forward; it did not decide either question conclusively.
