On October 9, 2025, U.S. District Judge Jeannette A. Vargas dismissed Drake’s defamation suit against Universal Music Group (UMG), ruling that the challenged lyrics in Kendrick Lamar’s “Not Like Us,” viewed in the context of a heated rap battle, would not be understood by a reasonable listener as verifiable facts.
What did the judge actually rule?
Drake sued UMG, alleging that the company promoted “Not Like Us,” a Kendrick Lamar diss track that Drake said contained defamatory claims. Judge Vargas dismissed the case in the U.S. District Court for the Southern District of New York on October 9, 2025. Lamar was not a defendant in the suit. The court’s opinion and coverage of the case concern Drake’s claims against the label, not a lawsuit against Lamar.
The legal question was whether the challenged expression could support Drake’s defamation claims. The court considered how a reasonable listener would interpret the lyrics in their setting: an incendiary exchange in a rap battle. Judge Vargas wrote, “The broader context of a heated rap battle, with incendiary language and offensive accusations hurled by both participants, would not incline the reasonable listener to believe that ‘Not Like Us’ imparts verifiable facts about Plaintiff.” The opinion treats that context as central to its analysis.
Why isn’t this a ruling on who won the battle?
A defamation decision addresses legal claims, not the artistic or cultural score of a diss-track exchange. The court’s conclusion about whether listeners would take lyrics as verifiable facts does not determine which artist made the stronger track, persuaded more listeners, or won the battle. Calling the ruling a judicial declaration that Drake lost therefore confuses a legal outcome with a cultural judgment. Reporting on the ruling and coverage explaining the headline make the same distinction.

What happened after the dismissal?
Drake appealed the dismissal. Reporting on the Second Circuit docket described the appeal as pending in 2026, with surfaced filings through 2026. That reporting does not establish whether a later order changed the status, so the appeal’s current position should be checked against the live Second Circuit docket before stating it as current. The docket reporting is the source for the surfaced status.
