Dawoodi Bohra representatives have sought to keep qualifying community trusts outside Waqf Act administration, arguing that external Waqf Board oversight conflicts with their religious governance. That request followed an older, separate dispute over whether particular Bohra endowments were charitable trusts subject to ordinary trustee duties. A Joint Committee later recommended a broader public-charity trust exclusion, but the available parliamentary and government records do not establish a comprehensive exemption for every Bohra property.
What the historical dispute was about
A Bombay High Court account of the historical “Mullaji Case” describes litigation over a mosque, a tomb, offerings and investments connected to the Dawoodi Bohra community. The central legal questions were whether the assets were devoted to charitable purposes and whether their manager could be held to enforceable duties as a trustee.
The defendants argued that the Dai al-Mutlaq was accountable only to the Imam in seclusion and that his religious position was incompatible with ordinary trustee accountability. The court account says the judge rejected that claim of legal immunity in the case before him: he found the properties at issue charitable and the Mullaji a trustee, and rejected the argument that movable property could not be waqf.
That finding did not amount to a ruling about every Bohra property or every Dawat fund. The account says the court did not order an account or intervene in management on the record presented. It also notes that the appeal disposition qualified the treatment of an offering box and that the decree did not decide whether other gulla funds or general Dawat funds were charitable. The holding was bounded by the properties and issues before the court.

Why the 1986–2004 Supreme Court case is separate
Central Board of Dawoodi Bohra Community v. State of Maharashtra, W.P. (C) 740 of 1986, concerned the Bombay Prevention of Ex-communication Act, not an exemption from waqf law. The petition sought reconsideration of the Supreme Court’s 1962 decision upholding constitutional protection for the community leadership’s power to excommunicate on religious grounds.
The Supreme Court’s 2004 order dealt with the case’s referral to a larger bench and its listing history. It is a procedural order in that constitutional dispute, not the legal source of a waqf trust exclusion. The shared community name and long chronology can make the cases easy to conflate, but their questions were different.

How the request for exclusion entered the Waqf Bill debate
During consideration of the Waqf (Amendment) Bill, 2024, Dawoodi Bohra representatives told the Joint Committee that Board administration of community dedications would conflict with their religious governance. The Union government’s preliminary counter-affidavit in a Waqf Act challenge reproduces the community’s position that the Dai al-Mutlaq is regarded within the faith as sole trustee. These are representations made on the community’s behalf, not judicial findings about religious doctrine or the legal status of every trust.
The affidavit also records Dawat-e-Hadiyah’s account that Bohra public charitable trusts in Maharashtra had operated under the Maharashtra Public Trust Act, 1950, with Charity Commissioner permission when required, until the Waqf Act was applied to them. That history is presented as the organization’s representation, rather than as an independently adjudicated finding.

What the Joint Committee recommended
The Joint Committee’s report records submissions from Dawoodi Bohra and Aghakhani representatives and discusses a proposed second proviso to section 2. Its recommended wording would exclude a trust established or statutorily regulated under public-charity law by a Muslim for purposes similar to waqf. It covered trusts established before or after commencement and proposed that the exclusion apply notwithstanding a court judgment, decree or order.
This was a broader formulation than an exemption naming only the Dawoodi Bohra community. It is important to distinguish the Committee’s recommendation from the operative wording of an enacted statute: the report alone does not establish that the recommendation became law in precisely that form. Nor does it identify every trust or property that would qualify.

What “exemption” does—and does not—mean here
In this history, “exemption” refers most clearly to the exclusion Bohra representatives sought and the broader public-charity trust carve-out the Joint Committee recommended. It should not be read as proof that every Dawoodi Bohra trust or property is now outside Waqf Act regulation. The government affidavit and committee report do not establish the final operative wording and commencement details of that exclusion against a current consolidated statute, or its application to particular trusts in Maharashtra. A property-specific conclusion requires checking the statute in force, official implementation and any relevant court record.
The distinctions matter for any individual property: who holds legal title and administers it; whether the entity is registered or regulated under public-charity law; whether the property is treated as waqf under the applicable statute; and what oversight and appeal routes apply. A religious position, a party’s submission, a court holding and a legislative recommendation are different kinds of legal statement.

Whose position is documented
The parliamentary record documents institutional representations by community representatives and a committee recommendation. It does not establish that all Bohra members share one view, or set out the positions of reformist or dissenting members in this legislative process. Community advocacy should therefore be attributed to the bodies and representatives who made it, rather than presented as a unanimous view.
