What did the January 2025 report claim?
On January 13, 2025, TechCrunch relayed a Bloomberg report that Chinese officials had discussed a possible sale of TikTok’s US operations to Musk if the US law took effect. The report attributed the discussions to unnamed people familiar with the matter. It said China preferred TikTok to remain under ByteDance and that it was unclear how much ByteDance or TikTok knew about the alleged discussions.
TikTok denied the account, calling it “pure fiction,” according to TechCrunch. No public primary document in the cited reporting confirms the private discussions, so the claim should be understood as an attributed report—not evidence that Beijing approved a sale or that a deal was in progress.
Did Musk make an offer?
No. In remarks from a German forum in late January, reported by AFP on February 9, Musk said, “I’ve not put in a bid for TikTok and I don’t have any plans for what I would do if I had TikTok.” He added, “I’m not chomping at the bit to acquire TikTok.” The reported Chinese contingency did not become a Musk bid.

What did China say about a possible sale?
On February 5, 2025, The Washington Post quoted Chinese Embassy spokesperson Liu Pengyu saying: “The acquisition of businesses should be independently decided by companies in accordance with market principles.” He added: “If it involves Chinese companies, China’s laws and regulations should be observed.” Those comments did not confirm the reported Musk discussions or amount to approval of a sale.
Why was TikTok facing a US sale-or-ban deadline?
The Protecting Americans from Foreign Adversary Controlled Applications Act covered applications operated by ByteDance, TikTok and specified subsidiaries. Its prohibitions were due to take effect on January 19, 2025. The White House’s September 25, 2025 executive order later recorded that President Trump had issued an enforcement-delay order on January 20.

The law’s qualified-divestiture standard was about more than changing the name on an owner’s paperwork. The executive order described a qualifying arrangement as one that removes foreign-adversary control and prevents a continuing operational relationship with US operations. It identified cooperation over a content-recommendation algorithm and data-sharing agreements as examples of operational relationships.

The White House described 170 million Americans as TikTok users in 2025 and projected that preserving the business would generate $178 billion in US economic activity over four years. The latter was an administration projection, not a measured result. The Associated Press reported more than 200 million American users in 2026; that is a later figure from a different report and should not be treated as a directly comparable measurement.

Who owns TikTok US now?
TikTok finalized a US joint venture in January 2026; it was not acquired by Musk. The Associated Press reported that ByteDance retained a 19.9% stake and named Oracle, Silver Lake and MGX among the major investors. The Washington Post reported that each of those three investors held 15% and described a seven-member board with a US majority. AP said US users could continue using the same app.

The White House’s September 2025 executive order described a framework for a US-based joint venture majority-owned and controlled by US persons, with ByteDance and affiliates below 20% ownership. AP also noted uncertainty about whether licensing and retraining the algorithm are consistent with the law’s limits on continued cooperation with ByteDance. That is an unresolved compliance question in the cited reporting; it does not, by itself, establish either that the arrangement violates the law or that its safeguards are effective.
