The case was initially set for March 9, 2026, then moved to May 18. On May 4, the parties announced a settlement, averting trial. Public reports did not disclose its financial terms. A separate motion for Lively’s legal fees and costs was decided in August.
How the trial date changed

What the court decided before settlement
Lively alleged inappropriate conduct during filming and a retaliatory campaign that harmed her reputation. Baldoni denied harassing her or orchestrating a smear campaign. In April 2026, the court dismissed Lively’s sexual-harassment claims and other claims; retaliation-related claims remained unresolved when the parties settled.
The court’s employee-versus-independent-contractor analysis was central to its dismissal of the sexual-harassment claims. Because settlement came before trial, there was no jury verdict on the remaining disputed allegations. Settlement is not a finding that either side’s allegations were true or false, and it does not establish liability.
What is known about the settlement—and the later fee ruling
The parties announced their settlement on May 4, 2026. Public reports did not disclose its financial terms, so no particular settlement payment can be established from those reports. In a joint statement issued through their lawyers, the parties said that raising awareness and making a meaningful impact in the lives of domestic-violence survivors and all survivors was a goal they supported. They also expressed hope that the settlement would bring closure and allow those involved to move forward constructively and in peace.

The settlement papers preserved Lively’s motion for fees, costs, treble damages, and punitive damages under California Civil Code Section 47.1. On August 26, Judge Liman awarded her $363,245 in attorneys’ fees and $44,206 in costs, after she had requested $8 million. The award was a ruling on the preserved motion; it should not be mistaken for a publicly disclosed settlement payment.
A separate Wayfarer case
A related lawsuit brought by Baldoni and Wayfarer parties was a separate action from Lively’s claims. The court’s opinion on the fee motion recounts that Judge Liman dismissed their amended complaint in June 2025. It also says the court applied California’s fair-report privilege to Lively’s communication of her California Civil Rights Department complaint to The New York Times. That separate dismissal was not the settlement of Lively’s action.
