Coomi Kapoor sued Manikarnika Films, Kangana Ranaut’s production company, and Netflix over the film Emergency’s attribution to her book. Kapoor alleged that the attribution and the film’s content breached their agreement and harmed her reputation. The Delhi High Court later closed the suit after the parties settled through mediation; the reported outcome was not a ruling on whether her allegations were true.
What was the dispute about?
Kapoor’s 2015 book, The Emergency: A Personal History, published by Penguin Random House, examines India’s 1975–77 Emergency. According to The Indian Express, Kapoor said Aksht Ranaut approached her in 2021 about adapting a chapter concerning Indira Gandhi. She said she then signed a tripartite agreement with Manikarnika Films and Penguin Random House.
Her case concerned more than whether the film accurately portrayed history. Kapoor alleged that the film’s attribution to her book violated the agreement and could lead audiences to associate its disputed content with her work.
What did Kapoor allege about the agreement and the film?
As reported by The Indian Express, Kapoor said the agreement permitted artistic licence but required consistency with historical facts in the public domain. She also said it barred use of her name or book in promotion without her prior written approval. Kapoor objected to the Netflix disclaimer’s use of both “inspired by” and “based on” language, alleging that it conflicted with her understanding of the contract.

Kapoor also cited alleged historical inaccuracies. She said the film attributed the All India Radio ban on Kishore Kumar’s songs to Akbar Ahmed, whereas her book attributed it to then Information and Broadcasting Minister V.C. Shukla. She also objected to the film’s portrayal of journalist Nikhil Chakravarty as having been imprisoned. These are reported allegations and comparisons, not findings made by the court.
Hindustan Times quoted Kapoor as saying, “They ignored everything I wrote and presented rubbish.” That was her criticism of the film’s treatment of her book, not a judicial conclusion.

How did the companies respond?
Before the settlement, Manikarnika Films reportedly said Kapoor’s book was not the film’s sole reference, that creative liberties had been agreed, and that the company was not required to obtain script approval. Netflix reportedly said it had licensed the film from Zee Entertainment Enterprises, according to The Telegraph India. These positions were reported while the suit was ongoing; the available coverage does not establish that the court decided the disputed claims.

In November 2025, the Delhi High Court closed the case after the parties reached an amicable settlement through its Mediation and Conciliation Centre. LiveLaw reported the court’s order as saying: “The suit stands decreed in terms of the settlement. The parties shall remain bound by the terms of the settlement.”
