What did Jay Johnston plead guilty to?
Johnston pleaded guilty on July 8, 2024, to felony obstruction of law enforcement during a civil disorder, according to the U.S. Department of Justice. The charge concerned his conduct during the breach of the U.S. Capitol on January 6, 2021.
Johnston is an actor whose credits include Jimmy Pesto Sr. on Bob’s Burgers, as well as Arrested Development and Anchorman, as reported by the Associated Press.
What sentence did the judge impose?
U.S. District Judge Carl Nichols imposed the sentence on October 28, 2024. DOJ’s announcement lists the components:

- Restitution: $2,000.
The phrase “a year in prison” is shorthand; the precise prison term was one year and one day. AP reported that Johnston expressed regret for making it more difficult for police to do their job. Nichols said, “But his conduct on January 6th was quite problematic. Reprehensible, really.”
How did the sentence compare with the prosecution’s request?
In a sentencing memorandum filed October 21, 2024, prosecutors asked for an 18-month prison term. That was the government’s recommendation, not the sentence Nichols imposed. The filing described Johnston’s presence in the Lower West Terrace tunnel and argued for a sentence in the middle of the applicable Guidelines range. Those descriptions and arguments represent the prosecution’s position; the resulting sentence was 12 months and one day.

Was Jay Johnston pardoned?
Yes. On January 20, 2025, President Donald Trump issued a proclamation commuting the sentences of 14 specifically named people to time served and granting a full, complete, and unconditional pardon to all other individuals convicted of January 6-related offenses. Johnston was not among the 14 named for commutation, so he falls under the proclamation’s general pardon clause. The White House proclamation is the source for that clemency action.
