Horacio Gutiérrez Jr. says he believes he won his Season 40 elimination against Derrick Kosinski. The available reporting attributes that claim to Horacio, but does not establish that the show officially ruled in his favor—or explain the full review behind the result.
What happened in Horacio and Derrick’s elimination?
Season 40 of The Challenge, subtitled Battle of the Eras, included both Horacio and Derrick among its cast. Paramount’s season announcement identifies the season and cast, and its Season 40 episode guide lists the season’s episodes.
Derrick faced Horacio in an elimination. In a TV Insider interview, Derrick and Averey Tressler discussed the season’s struggles, including Averey’s role in targeting Derrick and Horacio as his elimination opponent. That interview provides context for the matchup, but does not resolve Horacio’s later claim.
Why does Horacio say he won?
In coverage published after the episode, Horacio disputed the result and said he believed he had actually won. The report attributes to him a recollection that he called for a check and heard the horn. Those details are Horacio’s account, not independently established facts about the official ruling.

The report is syndicated coverage from Yahoo Entertainment, and its accessible search excerpt supports the attribution of the claim. It is not a substitute for a primary production explanation or complete footage of the sequence.
Did Horacio officially beat Derrick?
The material available here does not establish that Horacio officially won. It also does not provide the full unedited elimination footage, the exact instructions given to the contestants, or a primary statement from production explaining how the result was reviewed and why. Without those, it is not possible to independently determine whether the horn, a check, or another rule detail should have changed the outcome.

Derrick’s TV Insider interview discusses his Season 40 elimination history and the surrounding game, but does not independently settle this specific dispute. MTV’s official podcast listing includes an episode with Horacio about that week’s betrayal and his standing with the cast; it does not document a final ruling either.
