The Manhattan criminal case over roughly 100 handwritten pages connected to the Eagles’ Hotel California album ended on March 6, 2024, when prosecutors dismissed it midtrial after about 6,000 pages of communications were disclosed late. That was not a jury verdict on who owned the pages. Don Henley said writer Ed Sanders could view his drafts but not keep or sell them; the defense argued Sanders received materials lawfully while working on an Eagles biography. The trial also touched on the band’s 1980 breakup and Henley’s allegations about pages stored in a converted barn.
What was the “Hotel California” lyrics trial about?
The dispute concerned approximately 100 handwritten legal-pad pages from the development of songs on the Eagles’ 1976 album Hotel California. Associated Press described them as lyrics in progress, not final master copies; the pages were associated with songs including “Hotel California,” “New Kid in Town” and “Life in the Fast Lane.” Not every page was necessarily a draft of the title song. AP’s trial report describes the materials and the prosecution’s account of how they passed through writer Ed Sanders and rare-book dealer Glenn Horowitz to memorabilia dealers Craig Inciardi and Edward Kosinski.
Prosecutors alleged the defendants were involved in selling stolen manuscripts. The defense disputed that account, arguing Sanders received the materials in connection with his work on a planned Eagles biography. The central question was whether Sanders had permission to consult the drafts, or had received the pages to keep and sell. The contested provenance—not the fact that the papers appeared in an auction listing—was at the heart of the case.
Did Don Henley say the pages were taken from his barn?
Henley testified that he had not given the drafts away and that Sanders had permission to view them, not take them for his own use or sell them. “I never gifted them or gave them to anybody to keep or sell,” he said, according to CBS News’ trial coverage. Henley also acknowledged that he could not recall every conversation from the late 1970s and early 1980s.

The converted-barn account comes from a separate source and should be understood as an allegation, not a court finding. In a federal complaint filed June 28, 2024, Henley alleged that he kept legal pads and memorabilia in boxes in a converted barn on his California property, which served as an apartment, office and storage space. The complaint says Sanders had access to materials there while researching the biography. It also says Henley kept no inventory of the barn’s contents, which helps explain why he alleged the absence was not noticed immediately. The complaint records Henley’s claims; it does not by itself prove what happened to the pages.
What did the defense say about permission and the evidence?
The defense argued that Sanders received the papers lawfully as part of the biography project and challenged Henley’s recollection of the arrangement. It pointed to historical communications, including a recorded 1980 phone call in which Henley said he would “try to dig through” drafts to help Sanders. The defense also cited a shipment label for a box sent to Sanders that did not list its contents. Henley testified there was no tape or document in which he authorized Sanders to keep and sell the pages. These pieces of evidence were argued over; the criminal case ended before a jury resolved the dispute.

The parties’ positions can be separated into three questions:
- What permission was given? Henley said Sanders could view the drafts but not retain or sell them. The defense said the materials were provided lawfully during the biography work.
- What do the surviving records establish? The reported evidence included a recording, correspondence and shipment records, but the shipment label did not identify the box’s contents. Henley also said he could not recall all conversations from that period, and his later complaint says he had no inventory of the barn.
- What did a court decide? The criminal prosecution was dismissed midtrial. That outcome did not decide ownership or current custody of the pages.
Why was the criminal case dismissed?
On March 6, 2024, prosecutors dismissed the case after disclosing about 6,000 pages of communications late in the trial. Manhattan assistant district attorney Aaron Ginandes told the court the delayed disclosures contained relevant information the defense should have had an opportunity to explore before Henley and other prosecution witnesses testified, according to AP.

The case therefore did not end with a conviction or a jury acquittal. Nor did the dismissal establish that the pages were stolen, that they were gifted, or who owned them. Henley’s June 2024 federal complaint sought return of the manuscripts, but the complaint alone does not establish the civil suit’s later outcome or who now has the pages.
What did the unpublished Eagles biography say about the 1980 breakup?
The trial brought up a planned biography Sanders worked on with the band around 1979–80. Eagles manager Irving Azoff testified that the manuscript delved into the group’s 1980 breakup and that Henley and Glenn Frey were “very disappointed” with it, as AP reported. That is the supportable account; the lyric case did not establish the full contents of the unpublished manuscript or verify every episode it may have described.

The breakup also arose during Henley’s testimony about his state of mind in a separate episode discussed on cross-examination. PBS/AP reported that he said he had been depressed about the breakup and sought “an escape” on the night of a 1980 incident raised in court. That testimony was not a finding about who could keep the lyric pages.

No. AP reported that Sotheby’s withdrew a 2016 auction listing for the Hotel California lyrics after learning that ownership was in question. The listing’s appearance does not establish that the consignors owned the pages, and its withdrawal did not settle the competing claims.

What is known about ownership now?
The criminal prosecution’s dismissal left the ownership question unresolved in that case. Henley’s later civil complaint sought the manuscripts’ return and set out his allegations about their storage and access, but the material available here does not establish the civil action’s final disposition or the pages’ current custodian. It would be inaccurate to state that a court has definitively ruled who owns them.
