Haliey Welch addressed the $HAWK memecoin fallout on December 20, 2024, saying she was cooperating with the legal team representing affected investors and directing people who had suffered losses to Burwick Law. Welch was not named as a defendant in the lawsuit filed the day before. A later case summary from Burwick Law, dated March 30, 2026, says an amended complaint names Welch and additional parties; that plaintiff-side summary is not a court finding or a verified statement of the case’s current status.
What Haliey Welch said about the lawsuit
In a post on December 20, 2024, Welch said she took the situation seriously, was cooperating with the legal team representing affected people, and wanted to help uncover the truth and resolve the matter. The Independent and Just Jared reproduced her statement as follows:
“I take this situation extremely seriously and want to address my fans, the investors who have been affected, and the broader community. I am fully cooperating with and am committed to assisting the legal team representing the individuals impacted, as well as to help uncover the truth, hold the responsible parties accountable, and resolve this matter. If you have experienced losses related to this, please contact Burwick Law using the link below.”
Her post directed affected investors to Burwick Law. It did not itself establish that any person or company was legally responsible for investor losses.

Who was named in the original complaint?
The first complaint was filed on December 19, 2024, in the U.S. District Court for the Eastern District of New York. It named overHere Limited, Clinton So, Alex Larson Schultz, and Tuah the Moon Foundation as defendants. Welch was not named in that initial filing.
The plaintiffs alleged that the defendants issued, promoted, offered, and sold $HAWK as an unregistered security, and that Welch’s celebrity status and connections were used to make the token more appealing. Those claims come from the plaintiffs’ complaint, an advocacy document; they are allegations, not findings that the token was legally a security or that a defendant committed wrongdoing.

How the case description changed
April 2025: lead plaintiff and co-lead counsel appointed
Wolf Popper reported that on April 23, 2025, the court appointed Alexander Escobar lead plaintiff and Wolf Popper and Burwick Law co-lead counsel for the proposed class. That is a procedural appointment. It does not mean the court certified a class or decided the claims in investors’ favor.
March 2026: Burwick Law describes an amended complaint
A Burwick Law case page dated March 30, 2026 describes the case as pending under the caption In Re $HAWK Token Securities Litigation, case number 1:24-cv-08650-AMD-JRC. The firm says an amended complaint names Alex Larson Schultz, Solana Sweeper, Memetic Labs LLC, overHere Limited, Clinton So, Tuah the Moon Foundation, Benjamin Chow, Meteora, Dynamic Labs Limited, Johnnie Forster, 16 Minutes LLC, Welch, and Doe defendants.

That later party list is the plaintiff-side firm’s description. It differs from the original complaint’s list, and by itself does not establish liability or confirm the current docket posture. Wolf Popper’s April 23, 2025 update says $HAWK launched on December 4, 2024, and reached a reported market capitalization of $491 million shortly after launch. The firm also reported a $16.69 million presale valuation. These are reported market-capitalization and valuation figures, not a measure of realized investor losses, proceeds, or damages.

Fast Company reported in February 2025 on an excerpt from a later Welch interview. Welch said she had understood the idea to be a “long-term coin,” trusted the person who brought it to her, and called that trust her biggest mistake. These are Welch’s reported recollections, not independent findings about the project’s design or anyone else’s conduct.
In the same reporting, Fast Company attributed to Welch’s account figures of 3% of the supply initially available for trading, 17% allocated to presale investors, $2.8 million raised by presale investors, and two-thirds reportedly sold quickly. Those figures are her account as reported by Fast Company; they do not independently establish who sold tokens, the reasons for any sales, or whether a sale was unlawful.

What the public record described here does—and does not—establish
- Welch’s statement: she said she was cooperating with the lawyers representing affected individuals and referred investors to Burwick Law.
- The original lawsuit: the December 2024 complaint named four defendants and made allegations about $HAWK’s promotion and sale; Welch was not among the defendants in that initial filing.
- Later procedural reporting: Wolf Popper reported a lead-plaintiff and co-lead-counsel appointment in April 2025. Burwick Law’s March 2026 page describes an amended complaint naming additional parties, including Welch.
