Was the Sexual Scene in Mid90s Legal to Film?

California law addresses minors in film representations involving sexual conduct, including simulated conduct. Public sources do not establish the production facts needed to determine whether the Mid90s scene complied.

Mid90s depicts a sexual encounter between young teen characters, but the available public sources do not establish what the performers did during filming. California law covers certain uses of minors in film representations involving sexual conduct, including simulated conduct; applying it to this scene would require production-specific facts that are not established here. The film’s R rating does not answer the legal question.

What does the film show?

Common Sense Media describes the encounter as involving young teens, including a character apparently around 13, and says the scene stops short of nudity. That is a description of what viewers see in the finished film, not a record of how the scene was staged or what the performers did on set. Common Sense Media’s parent guide also lists the film as R-rated for pervasive language, sexual content, drug and alcohol use, and some violent behavior or disturbing images involving minors.

What does California law say?

California Penal Code section 311.4 addresses knowingly promoting, employing, using, persuading, inducing, or coercing a minor to pose or model for a film or other representation involving sexual conduct. A California Senate analysis of AB 1831 reproduces the provision and explains that sexual conduct can include specified actual or simulated conduct. It states: “An act is simulated when it gives the appearance of being sexual conduct.” California Senate, AB 1831 analysis.

That language means a fictional scene or one without nudity cannot, by itself, settle the legal question. But a viewer’s impression of the finished scene is not enough to establish that a statutory violation occurred either. The cited material does not establish the performers’ ages, their conduct during filming, or other production circumstances necessary to apply the law to this particular scene.

Do child-performer permits settle the question?

No. California Labor Commissioner guidance explains permit requirements for specified paid services involving performers under 18, including actors. Those rules are relevant background on child performers, but they do not show whether a permit was required or obtained for this production, and they do not determine whether the scene’s staging complied with Penal Code section 311.4. Does the R rating prove the scene was legal?

No. The R rating is a content classification, not a legal ruling or certificate that a production complied with child-protection laws. The British Board of Film Classification describes how UK classification considers whether submitted material is against the law and applies a harm test that includes sexual activity; that UK process does not decide the legality of a California production. What can be concluded?

The defensible answer is that the available public material does not establish whether filming this particular scene was legal. A confident verdict would require reliable production facts and authoritative legal analysis applying the relevant law to those facts. The scene’s fictional context, its lack of nudity, and the finished film’s rating do not independently resolve that issue.
