The opening episode of Netflix’s Worst Ex Ever tells the story of Benjamin Obadiah Foster and his girlfriend, Justine Siemens, in Grants Pass, Oregon. Foster had pleaded guilty in Nevada to battery and domestic-violence battery after holding a girlfriend captive. In Oregon, he was charged after Siemens was found bound and unconscious; those charges never went to trial. During the search for Foster, authorities said they believed he was responsible for two men’s deaths. Foster died from a self-inflicted gunshot wound after a standoff on January 31, 2023.
Is Worst Ex Ever based on a true story?
Yes. Netflix’s opening episode is about a real case: the search for Foster after Siemens was found in Grants Pass, Oregon. Netflix Tudum describes the 2024 first season as a four-story true-crime series featuring interviews with survivors, victims’ families, and investigators. The episode focuses on the relationship between Siemens and Foster and the police hunt that followed.

The series is a documentary account, not a court judgment on every event it depicts. The distinction matters because Foster’s Nevada battery cases ended in guilty pleas, while the Oregon allegations were unresolved when he died.
What did Ben Foster do?
The Nevada case and guilty pleas
In 2019, Foster held a girlfriend captive in her Las Vegas apartment for about two weeks, according to an Associated Press account citing a Las Vegas police report. The report described seven broken ribs, two black eyes, and injuries caused by restraints. These are reported details of that case, attributed to the police report through AP.

In August 2021, Foster pleaded guilty to one felony count of battery and one misdemeanor count of battery constituting domestic violence. AP reported that the sentence was up to 30 months, with 729 days of pretrial jail credit. Nevada corrections officials told AP he was released the day he arrived at prison. These guilty pleas, rather than the separate 2017 charge, are the established Nevada court outcomes described in the reporting.
The 2017 charge
Forbes’ 2024 account reported that Foster had been charged with felony battery and domestic violence in Las Vegas in 2017 after an ex-girlfriend testified that he tried to strangle her. That charge and the reported testimony should not be confused with a conviction; the available account does not establish a guilty plea or verdict in that case.

What happened to Justine Siemens in Oregon?
On January 24, 2023, Siemens was found unconscious and bound in Grants Pass. Police sought Foster, and Oregon authorities charged him with attempted murder, kidnapping, and assault. Grants Pass Police Chief Warren Hensman said at a news conference, “We are laser-focused on capturing this man and bringing him to justice.” That was a contemporaneous statement about the search, not a court finding.
Foster was never tried on the Oregon charges. He died before the case could be adjudicated, so those charges remain allegations rather than convictions.

What happened to Ben Foster?
While authorities searched for him, investigators found the bodies of Richard Lee Barron Jr. and Donald Owen Griffith near Wolf Creek. AP reported that officials said they believed Foster was responsible for the deaths. That attribution was not tested at a criminal trial, and Foster was not convicted of killing either man.
On January 31, 2023, Foster was taken into custody after a standoff and died at a hospital from a self-inflicted gunshot wound, according to AP’s account of police statements. His death ended the possibility of a trial on the Oregon charges.
