What the jury decided in 2023

In May 2023, a Manhattan civil jury found Donald Trump liable for sexually abusing and defaming writer E. Jean Carroll and awarded her $5 million, according to TIME’s account of the verdict. TIME reports that the jury did not find Carroll had proved rape. This was a civil liability verdict, not a criminal conviction.

Why the later $83.3 million award is separate

A different jury awarded Carroll $83.3 million in January 2024 for defamatory statements Trump made about her. That was a separate defamation damages proceeding, not part of the 2023 $5 million award. CBS News reported the 2024 verdict; Carroll said in a CBS Mornings interview that she thought the jury had said “enough.” Her comment concerned that later verdict, not Melania’s response.

Where the two awards stood on appeal

The Second Circuit upheld the $5 million award in December 2024, according to the Associated Press. In a September 8, 2025 report, Axios reported that an appeals court had also upheld the separate $83.3 million judgment. These are distinct judgments based on different proceedings.
