Rochelle Pinto made that argument in a historical Scroll.in article published January 21, 2016. The “public library” in the title was a metaphor: a user-contributed digital repository, not a physical library.
What was aaaaarg?
Pinto described aaaaarg as a website for sharing scholarly texts, initiated by artist Sean Dockray in 2005 under the name aaaaarg.org. Readers and researchers contributed scans. At the time of her article, she said the project was hosted at aaaaarg.fail by Marcell Mars, whom she quoted: “The goal is to keep the public library”.

That description captures the repository’s appeal as Pinto presented it: readers could encounter texts in one shared online collection rather than rely only on materials available through their own institution. It does not establish the website’s present availability or operating status.
Why did the case matter to Indian scholars?
Pinto’s central point was that access to scholarly material is uneven. In her account, books and other texts could be difficult for readers in India to obtain through ordinary channels, while university access might depend on registration, work on campus, or library systems with adequate infrastructure. She cited a University Grants Commission figure of 33.3 million college students, but did not identify the statistic’s reference year; it is a figure reported in her 2016 article, not a current enrollment count.

The article set the shared collection alongside other routes to material, including Delnet, Shodhganga, university databases, and inter-library loans. Pinto noted that some options involved institutional eligibility or restrictions. Her account explains why a user-contributed repository could matter to readers outside well-resourced or fully connected university systems; it is not a quantified comparison of those services, and their current access rules are not established here.
What was the Quebec dispute about?
Pinto reported in 2016 that an unidentified publisher had brought a case in Quebec and that users feared the project could be shut down. A later book excerpt describes a scanned translation of André Bazin’s What Is Cinema? and reports a claim for $500,000 Canadian dollars against Dockray and Mars. A January 2016 fundraiser also described a $500,000 suit. These are reported accounts of the claim, not a final court record establishing the outcome.

The sources available for this account do not establish a final judgment, settlement, dismissal, or the case’s present status. The dispute should therefore be understood as Pinto reported it in 2016, not as a case known to be ongoing or resolved today.
How did Indian copyright enter the discussion?
Pinto framed Section 52 of India’s Copyright Act of 1957 as providing an exception for educational use, making it part of the broader debate about access to learning materials. That is her characterization in a 2016 article. It is not legal advice, nor does it establish that any particular copying, upload, or distribution is lawful. Copyright questions depend on the applicable law and facts; the article’s framing should not be treated as a blanket ruling about the repository.

Read as a piece of 2016 reporting and commentary, the story is less about a conventional library than about who can reach scholarly work, through which institutions, and at what cost—and what happens when an informal route to that material faces a copyright challenge.
