According to the NYT Mini Crossword help page, access is included with NYT Games, All Access, and Home Delivery plans that include Games. Subscribers can play in the Games app, on the web, or in the News app. The same help page says daily Minis are available the evening before publication: weekdays and Saturdays at 10 p.m. EST the previous day, and Sundays at 6 p.m. EST on Saturday. Those are Eastern Time publication times.
