What did the court decide?
The dispute concerned republication of the photographs and the parties’ rights in that specific case. On March 29, 1983, the New York Court of Appeals ruled 4–3 in favor of Gross, according to United Press International’s contemporaneous report. That outcome belongs to the facts and legal proceedings of the Shields–Gross dispute; it should not be treated as a broad or current rule governing images of children.
