Johnny Gioeli sued Sega of America over “Live and Learn,” the song associated with Sonic Adventure 2 and Crush 40, because he said he retained a co-ownership interest in the music and was owed compensation for its use. In 2025, a court ruled for Sega on the claims still before it—not by deciding every question of ownership, but by finding Gioeli’s ownership claim was filed too late under the Copyright Act’s three-year limitations period.
What was the dispute about?
The disagreement concerned the musical composition of “Live and Learn,” not whether Gioeli wrote its lyrics. A February 1, 2001 services agreement covered Gioeli writing lyrics for the song. In the court record, Gioeli conceded that he was “not . . . claiming ownership” of the lyrics; his remaining ownership claim concerned the music and arrangement.

Gioeli’s position was that the agreement did not transfer the composition rights he claimed. Sega argued that the game’s credits and copyright notice, followed by the song’s releases, made clear that Sega rejected any claim by Gioeli to own the composition.
Why did Gioeli sue Sega?
Gioeli filed suit in December 2024 over rights and compensation relating to Sega’s use of “Live and Learn.” His complaint and contemporaneous reporting described uses beyond the original game, including re-releases and other titles. GameSpot reported Gioeli’s allegation that the song had appeared in at least 25 games; that figure was an allegation, not a court finding that each use was unauthorized.

The lawsuit therefore raised two connected issues: whether Gioeli had a co-ownership interest in the composition, and whether Sega owed him an accounting or compensation for uses of the song. The court’s ruling disposed of the claims that remained through its limitations analysis.
Why did the court rule for Sega?
The Copyright Act requires a civil action to be brought within three years after a claim accrues. For a copyright ownership claim, the court applied the “plain and express repudiation” standard: the limitations clock begins when the claimant receives clear notice that the other party rejects the asserted ownership.

The court concluded that the 2001 Sonic Adventure 2 credits and copyright notice supplied that notice. The credits did not name Gioeli and identified Sega contributors, while the copyright notice named Sega. On that basis, the court found the ownership claim time-barred and granted Sega summary judgment on it. Because the accounting and unjust-enrichment claims depended on the ownership claim, those claims failed as well.
The result was a limitations ruling. It did not broadly adjudicate every possible question about ownership of “Live and Learn,” nor did it find that each later use alleged by Gioeli was unauthorized or authorized.

Did Gioeli win, and who owns “Live and Learn”?
Gioeli did not win the remaining claims in court: Sega received summary judgment because the court found the ownership claim was outside the limitations period. But that procedural basis should not be mistaken for a ruling resolving every underlying ownership question. In September 2025, Gioeli himself characterized the result as a timing dismissal and said the song remained in an “abyss of ownership”; that is his view, not a judicial holding.
Accordingly, the public case record described here does not establish a new, comprehensive ownership determination. It establishes why the claims in this lawsuit failed.
Can Sega still use the song?
In January 2026, Time Extension reported that Sega used a “Live & Learn” remix in anniversary material and that Gioeli responded “all is good” to a fan. That is a positive public signal, but it does not disclose a settlement, license terms, or a new court ruling on ownership. The reported use alone cannot establish the legal basis or terms under which Sega used the track.
