Why Sean Combs’s Request for Release Before Sentencing Was Denied

A federal judge denied Sean Combs’s renewed request for release before sentencing on August 4, 2025, after his lawyers proposed a $50 million bond.

Sean “Diddy” Combs was not released before sentencing: a federal judge denied his renewed request for bail on August 4, 2025. Combs’s lawyers had proposed a $50 million bond and argued that he could be released under strict conditions, but Judge Arun Subramanian concluded that Combs had not met the legal burden for release. The request followed a split jury verdict and came before sentencing then scheduled for October 3, 2025.

What Combs asked the court to do

In a motion dated July 29, 2025, Combs’s lawyers asked the court to release him on conditions while he awaited sentencing. They relied on an exception in 18 U.S.C. § 3145(c), arguing that exceptional reasons made continued detention inappropriate. The motion proposed a $50 million bond and maintained that Combs was neither a flight risk nor a danger. Those were arguments by the defense, not findings by the court. How the jury’s verdict set the context

The release request came after a split verdict. The jury acquitted Combs of racketeering conspiracy and sex trafficking, but convicted him on two counts of transportation to engage in prostitution. Why the judge denied the request

On August 4, 2025, Judge Arun Subramanian denied the renewed motion. The order said Combs had not shown by clear and convincing evidence that he was not likely to flee or pose a danger, and that exceptional reasons for release had not been established. It discussed evidence of violence, coercion, or subjugation connected with the prostitution-related conduct. The judge wrote, “Combs fails to satisfy his burden to demonstrate an entitlement to release,” and concluded: “The motion for bail is DENIED.” Read the August 4 order.

The judge also expressly said the bail ruling did not resolve the parties’ competing arguments for sentencing. In other words, the decision addressed whether Combs should remain detained before sentencing; it was not a decision on what sentence to impose.

What happened after the denial

Combs remained in custody and was sentenced in October 2025 to 50 months in federal prison, according to a September 4, 2026 report by The Washington Post. That report said Bureau of Prisons records listed February 5, 2028 as his anticipated release date, while noting that the date had changed several times. Treat it as an estimate, not a guaranteed release date. The report also said Combs was appealing his sentence and conviction. Read the Washington Post’s later status report.
