Pauly Shore was named as a defendant in a lawsuit filed by Eliot Preschutti in Los Angeles Superior Court in April 2024. The complaint alleges that Preschutti was assaulted by security staff at The Comedy Store in West Hollywood on December 15, 2023. These are allegations in a civil lawsuit, not findings that Shore or anyone else was liable.
What does the lawsuit allege?
According to the Los Angeles Times, the complaint places the incident around midnight. Preschutti reportedly said he left the club before closing his bar tab. Employees called out to him, and he returned to pay after staff told him they still had his debit card.
The complaint’s reported account says bouncers detained Preschutti after a staff member accused him of trying to hit a server. One bouncer allegedly threw him face-down onto the sidewalk, after which five to seven bouncers allegedly kicked and hit him. Part of the incident was reportedly filmed and posted online. The lawsuit says, “At times, their acts became so violent that other bouncers attempted to restrain them, lest they kill Plaintiff.” That is language attributed to the complaint, not a court finding.
Preschutti reportedly alleged that a bouncer shouted, “This is for Pauly!” The Times also reported that he said he went to Cedars-Sinai Medical Center on December 17, 2023, after sleeping for about 24 hours, and claimed physical and emotional harm. These details describe the plaintiff’s account as reported from legal documents.

Who filed the case, and what does it seek?
Eliot Preschutti filed the case in Los Angeles Superior Court in April 2024. Pauly Shore and The Comedy Store were named as defendants. The reported causes of action include assault, battery, negligence, premises liability, negligent hiring, aiding and abetting tort, and intentional infliction of emotional distress.
Preschutti sought unspecified compensatory and punitive damages, legal fees, and a jury trial. Those are requests in the complaint; they do not establish liability or indicate that a court awarded damages.

Is this the same as the earlier Comedy Store lawsuit?
No. A separate action reported in January 2024 involved Sean Kehoe and his daughter, Kirra Lyn Potts, and concerned a different alleged incident in 2022. That matter has different plaintiffs and a different incident date; it should not be conflated with Preschutti’s lawsuit over the alleged December 2023 incident. Similarities in venue or defendants do not make them the same case.

The case’s current docket status and disposition are not established here. The Los Angeles Superior Court provides public case-name and case-number lookup services, but a case-specific docket was not available in the cited reporting. The Times said at the time of its report that Shore and the Comedy Store’s general manager had not immediately responded to its request for comment; that publication-time note is not a current statement from either party. Without a verified docket or later reliable report, it would be inaccurate to describe the case as pending, dismissed, settled, or decided.
