Artem Chigvintsev was arrested on August 29, 2024, and Napa County prosecutors announced on September 24 that they would not file criminal charges. District Attorney Allison Haley said the decision followed a review of the investigation and evidence, which prosecutors concluded did not meet the standard required to bring a charge.
Why did prosecutors decline to file charges?
The Napa County District Attorney’s Office said it had reviewed the criminal investigation and carefully evaluated the evidence presented to it. Haley said prosecutors have an ethical obligation to file charges only when evidence supports them, and must be able to prove every charge beyond a reasonable doubt.

“If the available evidence doesn’t rise to this level of proof, then we cannot ethically file charges,” Haley said in the office’s September 24, 2024 announcement. The office did not publish further details about the evidence or explain how it assessed particular accounts or facts.

Was this a finding that Chigvintsev was not guilty?
No. The DA’s announcement was a prosecutorial decision not to file charges; it was not an acquittal, a dismissal after trial, or a court ruling on whether the alleged conduct occurred. Because no criminal case proceeded to a verdict, the announcement should not be described as a finding of guilt or innocence.

The office said it would not disclose the identity of the alleged victim or provide further information about the case. It also said it could revisit the matter within the applicable statute of limitations if it learned of other incidents, facts, or evidence that were not previously known.
