The Seventh Circuit upheld dismissal of her Wisconsin case without prejudice because New Zealand was the more appropriate forum for the dispute. The court did not decide the merits.
What Pavlovich alleged in her complaint
On February 3, 2025, Scarlett Pavlovich filed a federal complaint in the Western District of Wisconsin naming Gaiman and Amanda Palmer. The complaint alleged that Gaiman sexually abused Pavlovich and that Palmer procured or presented her to him for abuse. Pavlovich’s complaint placed the alleged events in New Zealand, where she said she worked as a babysitter and live-in nanny for Gaiman’s family. These are allegations, not court findings. Why the Wisconsin case against Gaiman was dismissed
In October 2025, the U.S. District Court for the Western District of Wisconsin dismissed the remaining claims against Gaiman without prejudice under the doctrine of forum non conveniens. The court concluded that New Zealand was an available, adequate, and more appropriate forum. In deciding that procedural question, it accepted well-pleaded allegations as true for the limited purpose of the motion and did not consider evidence Gaiman submitted disputing the misconduct claims. What the Seventh Circuit decided—and what it did not
On June 29, 2026, the U.S. Court of Appeals for the Seventh Circuit affirmed the dismissal. It found no abuse of discretion in the district court’s decision that New Zealand was the more convenient forum, emphasizing the dispute’s connection to that country. Read the Seventh Circuit opinion.

The appeals court did not decide whether the alleged conduct occurred. Nor did it reach Gaiman’s separate argument about whether the federal trafficking statute’s civil remedy applies extraterritorially: the forum ruling disposed of the case before that question needed to be answered. Because the dismissal was without prejudice, it was not a judgment rejecting the allegations on their merits.
Gaiman’s response
The Guardian reported Gaiman’s denial: “I’m far from a perfect person, but I have never engaged in non-consensual sexual activity with anyone. Ever.” That statement is his response to the allegations; it is not a court finding. The Guardian’s report covered his denial.

How the Palmer litigation differs
The Wisconsin complaint initially named both Gaiman and Palmer, but the litigation involving them did not proceed as a single continuing case. Pavlovich dropped the New York case and the Wisconsin portion involving Palmer. A separate Massachusetts case against Palmer was dismissed on forum grounds, and its appeal to the First Circuit is a distinct procedural matter. The latest docket snapshot available for that appeal recorded Palmer’s appellee brief on August 3, 2026, and a reply deadline of August 18; that snapshot was last retrieved August 5 and does not establish what happened afterward.
