What Musk’s meme showed
A screenshot reproduced in a January 2026 amended complaint shows Musk’s X post dated March 20, 2025. In the image, Trump stands beside a grave marker bearing the Department of Education seal. The marker reads “Departmen of Education,” omitting the final “t” in “Department.” The typo became the post’s most conspicuous detail, turning a political image about closing the agency into a widely recognizable spelling joke. The screenshot displayed 1.1 million views at the time it was captured; that is a historical snapshot, not a current or independently audited total. Court filing screenshot.
Why the post appeared that day
Musk posted the image on the same day Trump signed an executive order directing Education Secretary Linda McMahon to take steps toward closing the Department and returning education authority to states and local communities. The order qualified that direction: steps were to be taken “to the maximum extent appropriate and permitted by law,” while ensuring uninterrupted delivery of services, programs, and benefits Americans rely on. McMahon’s statement that day described the administration’s stated approach: “We’re going to follow the law and eliminate the bureaucracy responsibly by working through Congress to ensure a lawful and orderly transition.” McMahon’s statement.

What the executive order did—and did not do
The order set an administrative objective; it did not itself legally abolish the Department. Congress created the agency, and a president cannot eliminate it by executive fiat, PolitiFact explains. The wording requiring action only as far as law permits acknowledged that limit. A reader asking how a country could function without a federal education department is therefore asking a larger policy question than the meme answers: the order called for a transition, not an immediate disappearance of every federal education function or benefit. Workforce reductions were separate from abolishing the agency
On March 11, 2025, the Department said it had 4,133 workers when Trump took office and described its planned reduction in force as affecting nearly 50% of its workforce. The Department said statutory programs would continue, including formula funding, student loans, Pell Grants, special-needs funding, and competitive grants. Those figures and assurances represent the Department’s own account of its plans; a workforce reduction is not the same thing as repeal of the statutes establishing programs or the agency. The later court action
The Department’s FAQ reports that on May 22, 2025, a federal judge issued a preliminary injunction barring implementation of the March 20 order and related actions. The FAQ also says agency defendants appealed. That is the procedural status described by the Department FAQ; it does not establish the final outcome of the litigation. Department FAQ.
