A federal judge did not decide that Netflix was liable for Baby Reindeer. But in a September 2024 procedural ruling, Judge R. Gary Klausner said Fiona Harvey had plausibly alleged that viewers could identify her as the person portrayed by Martha—and that the series’ opening “This is a true story” framing mattered. The ruling allowed some of Harvey’s claims to proceed; it was not a final finding that her allegations were true.
What the judge said about identification and the “true story” label
Harvey’s June 6, 2024 complaint alleged that Netflix’s series portrayed her through the character Martha. In his September 27, 2024 order, Klausner found that the alleged similarities between Harvey and Martha were specific enough to make identification plausible: the complaint said few other people could share the combination of traits at issue. The court was assessing whether the claims could proceed at that stage, not deciding the facts after a trial.
The series’ opening statement, “This is a true story,” also mattered to the court’s analysis. The judge considered how that framing could lead viewers to treat the portrayal as factual. It did not, by itself, establish that every viewer identified Harvey or that Netflix was liable.
Why the distinction between an allegation and a conviction mattered
Harvey alleged that the series falsely depicted her as convicted of stalking and imprisoned, and attributed severe violent and sexual conduct to her. Those are allegations in her complaint, not established facts. Klausner emphasized the difference between the conduct alleged and the more serious events the series depicted.

Klausner also wrote that “there are major differences between inappropriate touching and sexual assault, as well as between shoving and gouging another’s eyes.” He made these comparisons while explaining the alleged gap between real-life conduct and the drama’s portrayal; they were not findings that Harvey committed the conduct in question.

What claims survived the September 2024 ruling
Harvey sued Netflix, Inc. and Netflix Worldwide Entertainment, LLC, asserting defamation, intentional infliction of emotional distress, negligence, gross negligence and right-of-publicity claims. Klausner denied Netflix’s special motion to strike and granted its motion to dismiss in part. Defamation and intentional infliction of emotional distress claims were allowed to proceed at that stage; other claims were dismissed.
That is a procedural result, not a verdict. A claim surviving a motion does not prove the plaintiff’s account, establish Netflix’s liability or resolve what the evidence would show at trial.

How the case’s status affects what can be said now
Netflix appealed the denial of its special motion to strike. The district court stayed proceedings while the appeal was pending and vacated the pretrial schedule and trial date. The latest dated docket information established here is a secondary docket record updated July 28, 2026. That record supports the appeal-and-stay posture as of its update; it does not establish what happened afterward. No final outcome should be inferred from it.
Netflix’s response, reported by ITV News on September 30, 2024, was: “We intend to defend this matter vigorously and to stand by Richard Gadd’s right to tell his story.” That was the company’s position, not a conclusion by the court.

What stronger identity protection could mean in practice
The ruling highlights why changing a name alone may not settle whether a real person is identifiable. A character can still be recognizable through a distinctive combination of biographical, occupational, linguistic or online details. A production can also shape how audiences interpret those details through its truth claims and other framing.
- Identity masking: Consider the combined effect of identifying details, not just whether a character has a different name.
- Truth framing: An unqualified “true story” label can encourage viewers to treat dramatized events as factual.
- Procedural caution: A court’s finding that identification or a claim is plausible at the motion stage is not proof after evidence and trial.
These are the issues raised by the ruling, not a judicial checklist or a finding that any particular alternative would have prevented a lawsuit.

Why the stakes extended beyond the lawsuit
ITV News reported that Baby Reindeer received 68 million views in the UK in April 2024, citing YouGov data. That figure illustrates the scale at which viewers could encounter the portrayal; it does not show how many viewers identified Harvey or establish any legal element of her case.
