After the Kerala High Court rejected Malayalam actor Siddique’s anticipatory-bail application on 24 September 2024, the Supreme Court first protected him from arrest and later allowed his appeal. On 19 November 2024, it directed that he be released on bail if arrested, subject to conditions imposed by the trial court. The order did not decide whether the allegations were true.
What is the case about?
The Supreme Court identified the matter as Siddique v. State of Kerala & Anr., Criminal Appeal No. 4625 of 2024, arising from SLP (Criminal) No. 13463 of 2024. The appeal challenged the Kerala High Court’s 24 September 2024 order in Bail Application No. 7331 of 2024. The FIR, Museum Police Station Crime No. 1192 of 2024, was registered on 27 August 2024 in Thiruvananthapuram City under Sections 376 and 506 of the Indian Penal Code. The Supreme Court judgment describes the alleged incident as having taken place in 2016, with the complaint lodged almost eight years later. Supreme Court judgment
Contemporaneous reporting said the complainant alleged that Siddique raped her at a Thiruvananthapuram hotel in 2016. Siddique denied the allegations; The Indian Express reported that he called them a “criminal conspiracy to tarnish the reputation of the entire Malayalam film industry.” The allegation and his denial are accounts by the parties, not findings established by the bail order. How the bail proceedings unfolded
- 24 September 2024 — Kerala High Court rejects anticipatory bail. The High Court dismissed Siddique’s application. Its judgment records arguments by the prosecution and complainant about evidence, the investigation, concerns about witnesses and the need for custodial interrogation. Siddique argued that the complaint came after a long delay. These were submissions made at the bail hearing; the decision was not a trial verdict. Kerala High Court judgment
- 30 September 2024 — Supreme Court grants interim protection. While issuing notice on Siddique’s challenge, the Supreme Court temporarily protected him from arrest. This was an interim measure pending its decision on the appeal. Supreme Court interim order
- 19 November 2024 — Supreme Court allows the appeal. The Court directed that if Siddique was arrested in connection with the FIR, he was to be released on bail, subject to conditions imposed by the trial court. It included depositing his passport and cooperating with the investigating officer among the conditions the trial court could impose. The judgment said a breach of the imposed conditions could lead to cancellation of bail. Supreme Court judgment
- September 2025 — reported permission for specified foreign travel. Onmanorama and Cinema Express reported that the Thiruvananthapuram First Class Judicial Magistrate Court relaxed the travel restriction for specified trips to the UAE and Qatar. The reports said the passport was released for those trips and had to be returned afterward. Onmanorama report; Cinema Express report
What the Supreme Court’s order did—and did not—decide
The Supreme Court noted the interval between the alleged 2016 incident and the complaint, referred to a Facebook post the complainant had made in 2018, and noted that she had not gone to the Justice K. Hema Committee. It expressly declined to give elaborate reasons, citing the sensitivity of the case: “Having regard to the submissions made by the learned senior counsels for the parties and perusing the documents on record including the pleadings, we deem it appropriate not to assign elaborate reasons, particularly considering the sensitivity of the case.” Supreme Court judgment

The operative direction was conditional: “In that view of the matter, it is directed that in the event of arrest of appellant in connection with the F.I.R. being Crime No.1192 of 2024 dated 27.08.2024 registered at Police Station Museum, District Thiruvananthapuram City, for the offence under Sections 376 and 506 IPC, he shall be released on bail, subject to the conditions that may be imposed by the Trial Court”. This was a bail decision, not an acquittal or a finding of guilt.

The September 2025 reports concern travel permission and passport arrangements. The sources cited here do not establish a later trial judgment or final disposition. The Supreme Court’s bail order therefore should not be read as showing that the criminal case itself concluded.
